<br />determin;ng Grantor's variance application in relation to area requirements but exclusive of the <br />conditions herein. Grantee does not and cannot promise, guarantee or grant such a variance, by <br />and through this Easement, but the Grantee can and does represent, as stated above, that it <br />recognizes and acknowledges the location of the easement as a valid consideration for the BZA <br />in a variance application and proposal by Grantor to locate its building. <br />The Grantor hereby agrees to restrict the use of said prernises within the limits of the <br />above described easement against the construction thereon or above or subjacent thereto any <br />buildings, structures, tunnels, or excavation therein in any manner interfering with said sewer <br />whatsoever, the access thereto, or the maintenance thereof, or otherwise interfering therewith; <br />provided that, notwithstanding the foregoing restrictions and prohibitions Grantor may make any <br />of the uses or do any of the things to the foregoing premises with the express written consent of <br />the Grantee. Such reserved and permitted usage sha11 include inter alia, landscaping, parking of <br />vehicles within the regulations set forth in the Codified Ordinances, paving, streets, driveways, <br />sidewalks and the maintenance thereof, all within the regulations set forth in the North Olmsted <br />Codified Ordinances. <br />Grantor shall fully use and enjoy the aforesaid premises except as to tlie rights herein <br />granted; and Grantee agrees to maintain the sewer line, and keep hold and save the saad Grrantor <br />harmless for any and all damages arising from its use of the right, easement, and right-of-way <br />herein granted and agrees to maintain, repair and restore to its original condition, (except for <br />removal of necessary trees and sl-irubs) the premise located within said right-of-way. <br />, . .. , .. <br />e <br />?.
