Grantee does not and cannot promise; guarantee or grant such a variance, by <br />and throuah this Easement, but the Grantee can and does represent, as stated above, that it <br />recognizes and acknowledges the location of the easement as a valid consideration for the BZA <br />in a variance application and proposal by C'xrantor to locate its buildi.ng. <br />The Grantor hereby agrees to restrict the use of said prem.ises within the limits of the <br />above described easement against the construction thereon or above or subjacent thereto any <br />buildings, structures, tunizels, or excavation therein in any manner interfering with said sewer <br />whatsoever, the access thereto, or the maintenance thereof, or otherwise interfering therewith; <br />provided that, notwithstanding the foregoing restrictions and prohibitions Grantor may make any <br />of the uses or do any of the things to the foregoing premises with the express written consent of <br />the Grantee. Sucll reserved an.d permitted usage shall include i.nter alia, landscaping, parki.ng of <br />vehicles withi.n the regulations set forth in the Codified Ordinances, paving, streets, driveways, <br />sidewalks and the maintenance thereof, a11 within the regulations set forth in the North Olmsted <br />Codified Ordinances. <br />Grantor sha11 fully use and enjoy the aforesaid premises except as to the rights herein <br />granted; and Grantee agrees to maintain the sewer line, and keep hold and save the said Grantor <br />harmless for any and all damages arising from its use of the right, easement, and right-of-way <br />herein gralited and agrees to maintain, repair and restore to its original condition, (except far <br />removal of necessary trees and sllrubs) the premise Iocated within said right-of-way. <br />. ?. <br />???.??? ... .
