CITY OF NORTH OLMSTED ORDINANCE NO. 2003 -104 BY: Council Member Kasler AN ORDINANCE AMENDING SECTIONS 373. 06, 373. 08, AND 373.15 OF CHAPTER 373 OF THE TRAFFIC CODE, ENTITLED "BICYCLES AND BICYCLE REGISTRATION, " IN ORDER TO MA%E I.ANGUAGE CORRECTIONS TO CERTAIN SECTIONS OF THE CHAPTER AND TO AMEND OTHER SECTIONS TO IMPROVE BICYCLE SAFETY IN THE CITY, AND DECLARING AN EMERGENCY. WHEREAS, this Council, on September 17, 2002, adopted Ordinance No. 2002- 125, which updated the licensing provisions of Chapter 373 of the Traffic Code entitled "Bicycles and Bicycle Registration," and made certain other changes to make the Chapter more consistent with State law; and WHEREAS, the Safety Committee of Council recently conducted committee meetings regarding bicycle safety, and received recommendations from the North Olmsted police department and bicycle safety activists to make certain additional improvements to the City's Bicycle Code, including both technical language changes and changes to improve bicycle safety; and WHEREAS, it is the desire of this Council to adopt legislation to implement the recommendations made; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Sections 373.06, 373.08 and 373.15 of Chapter 373 of the Traffic Code entitled "Bicycles and Bicycle Registration," which presently read as follows: "373.06 LICENSE ISSUANCE OR REFUSAL; RECORDS. (a) The Chief of Police, upon receipt of the proper application accompanied by the required fee, is authorized to issue a bicycle license which shall have no expiration. (b) The Chief of Police shall not issue a license for any bicycle when he knows or has reasonable grounds to believe that the applicant is not the owner or entitled to the possession of such bicycle, or that such bicycle is not in safe operating condition. (c) The Chief of Police shall keep a record of the number of each license, the date issued, the name and address of the person to whom issued, the name and address of the owner's parents or guardian if the owner is a minor, the name of the manufacturer, color,
