? <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2003 -104 <br />BY: Council Member Kasler <br />AN ORDINANCE AMENDING SECTIONS 373. 06, 373. 08, AND <br />373.15 OF CHAPTER 373 OF THE TRAFFIC CODE, ENTITLED <br />"BICYCLES AND BICYCLE REGISTRATION, " IN ORDER TO <br />MA%E I.ANGUAGE CORRECTIONS TO CERTAIN SECTIONS OF <br />THE CHAPTER AND TO AMEND OTHER SECTIONS TO <br />IMPROVE BICYCLE SAFETY IN THE CITY, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, this Council, on September 17, 2002, adopted Ordinance No. 2002- <br />125, which updated the licensing provisions of Chapter 373 of the Traffic Code entitled <br />"Bicycles and Bicycle Registration," and made certain other changes to make the Chapter <br />more consistent with State law; and <br />WHEREAS, the Safety Committee of Council recently conducted committee <br />meetings regarding bicycle safety, and received recommendations from the North <br />Olmsted police department and bicycle safety activists to make certain additional <br />improvements to the City's Bicycle Code, including both technical language changes and <br />changes to improve bicycle safety; and <br />WHEREAS, it is the desire of this Council to adopt legislation to implement the <br />recommendations made; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Sections 373.06, 373.08 and 373.15 of Chapter 373 of the <br />Traffic Code entitled "Bicycles and Bicycle Registration," which presently read as <br />follows: <br />"373.06 LICENSE ISSUANCE OR REFUSAL; RECORDS. <br />(a) The Chief of Police, upon receipt of the proper application accompanied by <br />the required fee, is authorized to issue a bicycle license which shall have no expiration. <br />(b) The Chief of Police shall not issue a license for any bicycle when he knows or <br />has reasonable grounds to believe that the applicant is not the owner or entitled to the <br />possession of such bicycle, or that such bicycle is not in safe operating condition. <br />(c) The Chief of Police shall keep a record of the number of each license, the date <br />issued, the name and address of the person to whom issued, the name and address of the <br />owner's parents or guardian if the owner is a minor, the name of the manufacturer, color,
