CITY OF NORTH OLMSTED gaL <br />ORDINANCE NO. 2003 -103 <br />BY: Mayor Norman T. Musial. <br />AN ORDINANCE AMENDING SECTIONS 950.03 (PERMITS <br />REQUIRED) OF CHAPTER 950 OF THE STREETS, UTILITIES <br />AND PUBLIC SERVICES CODE ENTITLED "URBAN FORESTS" <br />IN ORDER TO REGiILATE COMMERCIAL TREE TRIMMING <br />CONTRACTORS ON IMPROVED AND UNIMPROVED <br />RESIDENTIAL LOTS IN THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, in Ordinance No. 2003-69 this Council reviewed and amended the <br />duties of the City Forester with respect to Tree Preservation/Removal Permits, including <br />the scope of permit review and the fees required, focusing on commercial and multi- <br />family shade trees, and excluding from that permit process all tree trimming activities <br />upon single family residential premises; and <br />WHEREAS, it is the recommendation of the Mayor, upon the advice and <br />assistance of the City Forester, to regulate commercial contractors engaged in the <br />business of residential tree trimming in the City of North Olmsted so as to license andlor <br />permit same and to prohibit undue burden upon municipal resources, to wit, the practice <br />of leaving clippings or branches for collection by BFI or City Service crews; and <br />WHEREAS, this Council has reviewed the recommendations of the Mayor and <br />specifically finds that City services, whether delivered via BFI or Service crews (chipper <br />service), should be fully extended for the convenience of all residents but should be <br />limited so that commercial entities cannot take advantage of local programs to avoid the <br />costs of doing business; and <br />WHEREAS, it is accordingly the desire of this Council, based upon the <br />recommendations of the Mayor and its own legislative findings, to amend the appropriate <br />sections of Chapter 950 of the Streets, Utilities and Public Services Code in order to <br />require a permit for residential tree trimming by commercial enterprises; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Sections 950.03 ("Tree Preservation/Removal Permits <br />Required; Procedure; Fees."), which presently read as follows: <br />"950.03 TREE PRESERVATIONlREMOVAL PERMITS REQUIRED; <br />PROCEDURE; FEES. <br />(a) No person shall plant or remove any public, commercial or multi-family <br />
