CITY OF NORTH OLMSTED gaL ORDINANCE NO. 2003 -103 BY: Mayor Norman T. Musial. AN ORDINANCE AMENDING SECTIONS 950.03 (PERMITS REQUIRED) OF CHAPTER 950 OF THE STREETS, UTILITIES AND PUBLIC SERVICES CODE ENTITLED "URBAN FORESTS" IN ORDER TO REGiILATE COMMERCIAL TREE TRIMMING CONTRACTORS ON IMPROVED AND UNIMPROVED RESIDENTIAL LOTS IN THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS, in Ordinance No. 2003-69 this Council reviewed and amended the duties of the City Forester with respect to Tree Preservation/Removal Permits, including the scope of permit review and the fees required, focusing on commercial and multi- family shade trees, and excluding from that permit process all tree trimming activities upon single family residential premises; and WHEREAS, it is the recommendation of the Mayor, upon the advice and assistance of the City Forester, to regulate commercial contractors engaged in the business of residential tree trimming in the City of North Olmsted so as to license andlor permit same and to prohibit undue burden upon municipal resources, to wit, the practice of leaving clippings or branches for collection by BFI or City Service crews; and WHEREAS, this Council has reviewed the recommendations of the Mayor and specifically finds that City services, whether delivered via BFI or Service crews (chipper service), should be fully extended for the convenience of all residents but should be limited so that commercial entities cannot take advantage of local programs to avoid the costs of doing business; and WHEREAS, it is accordingly the desire of this Council, based upon the recommendations of the Mayor and its own legislative findings, to amend the appropriate sections of Chapter 950 of the Streets, Utilities and Public Services Code in order to require a permit for residential tree trimming by commercial enterprises; NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Sections 950.03 ("Tree Preservation/Removal Permits Required; Procedure; Fees."), which presently read as follows: "950.03 TREE PRESERVATIONlREMOVAL PERMITS REQUIRED; PROCEDURE; FEES.
