Ordinance No. 2003-103 <br />subject only to the notification of City Forester of any construction project that will affect <br />any public, commercial or multi-family residential trees. <br />(e) No permit shall issue to remove any commercial or multi-family residential <br />tree from a commercial or multi-family residential place, unless: <br />(1) With respect to a vacant or undeveloped lot, the owner or his designee <br />has first presented to the Architectural Review Board pursuant to <br />Section 1126.04(d) of the Planning and Zoning Code a drawing or <br />rendering setting forth his Tree Preservation/Removal and other <br />landscaping proposal for such lot, and such proposal has been accepted <br />by the Planning Commission; and <br />(2) With respect to a developed lot, the owner or designee obtains from <br />the City Building Commissioner written notice that the proposed <br />removal does not violate or conflict with any Tree <br />Preservation/Removal or other landscaping plan previously approved <br />by the City for such lot, pursuant to the applicable provisions of the <br />Zoning Ordinance. <br />(3) With respect to any lot being developed, redeveloped or otherwise <br />modified pursuant to Chapter 1126 or any other Chapter of the <br />Planning and Zoning Code, that the Tree Preservation/Removal and <br />other Landscaping Plans be evaluated by the City Forester, and then <br />subject to the review and approval of the Architectural Review Board, <br />prior to the issuance of said Tree Removal Permit. <br />(4) The Applicant has fully complied with the Tree Preservation & <br />Replacement Program, including the payment of any applicable fees, <br />prior to the issuance of a Tree Removal permit. <br />(fl Residential Tree Trimming Permit. No person, engaged in the business or <br />trade of tree trimming and/or removal, including landscapers but limited to their <br />tree trimming/removal activities, shall cut, trim or remove any tree with a diameter <br />breast height (DBH) of four inches (4") or greater, located on any lot or upon any <br />premises, particularly including single-family residences, without first procuring a <br />permit from the City Forester. As a condition of issuing such permit, the City <br />Forester s6a11 first require that the person receiving t6e permit shall abide 6y <br />arboricultural specification and standards of practice generally accepted by the <br />arboricultural trade, and follow any and all reasonable requirements, policies, or <br />other rules and regulations that may be established by the City Forester. Such rules <br />shall include, but are not limited to the requirement that said commercial tree <br />service personnel shall chip, grind, and otherwise completely remove from the <br />property any and all tree branches, limbs, trunks and all other debris resulting from <br />said activities, and the further prohibition against the abandonment of any such tree <br />branch, limb, trunk or other resultant debris upon City right-of-way or elsewhere. <br />For commercial and multiple-resident sites, such permit shall be subject to the Tree <br />Preservation/Removal Permit referred to herein and subject to all requirements <br />related thereto; For single family residential lots or premises, such permit s6a11 be <br />called the Residential Tree Trimming Permit, subject only to this subsection, and <br />issued at no cost.
