CITY OF NORTH OLMSTED ORDINANCE NO. 2003 - 102 BY: MAYOR NORMAN T. MUSIAL AN ORDINANCE ACCEPTING A SANITARY SEWER EASEMENT LOCATED ON PROPERTY OWNED BY HENNIE HOMES, ING AND DEVELOPED INITIALLYAS CINNAMON WOODS CONDOMINIUMS AND EXTENDING SUCH UTILITIES TO WILLOW WOODS CLUSTER H016iES, AND DECI.ARING AN EMERGENCY. WHEREAS, Hennie Homes, Inc. has offered an easement to the City of North Olmsted for a sanitary sewer line extending such services through Cinnamon Woods Condominiums and to Willow Woods Cluster Homes; and WHEREA.S, this Council has previously provided for the annexation of much of these lands and has also provided public funding to enlarge the capacity of and to otherwise expand the sanitary sewer service area in tius area, as an extension of a pubiic utility, the North Olmsted Wastewater Treatment Plant; and WHEREAS, the rules and regulations of the EPA, as well as the terms and conditions of the City's permit for the operation of the Wastewater Treatment Plant, require that the City insure that the sanitary sewer iines connected to the system are maintained in accordance with such regulations and are otherwise under the City's control; and N'HEREAS, it is the desire of this Council, upon the advice and recommendation of the Director of Law and the City Engineer, to accept this easement and to provide for the recording of such conveyance; and NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY QF CUYAHOGA, AND 5TATE QF OHIO: SECTION 1: That the Mayor is hereby authorized and directed to accept, on behalf of the City of North Olmsted, a sanitary sewer easement from Hennie Homes, Inc., the owner of certain real property as further described within the Standard Easement, attached hereto and incorporated herein by reference. SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause said easement to be recorded in the office of the Cuyahoga County Records.
