<br />Ordinance No. 2003-98 <br />condition of his lot or parcel does not, or did not in the prior year, violate any provision <br />of Section 949.03, or that the condition of the lot or parcel does not pose any immediate <br />danger to the health, safety or welfare of owners of surrounding properties, then the <br />Director shall, as appropriate, either modify or annul the notice of abatement or <br />inspection. No action, pursuant to Section 949.05 or 949.06, to enforce any notice of <br />abatement or inspection issued, shall be taken while an appeal pursuant to this paragraph <br />is pending. <br />949.05 ENFORCEMENT BY SERVICE DIlZECTOR; WORK BY CITY. <br />In the event the owner does not trim or remove any tree, lawn, grass, plant or <br />shrubbery, or any part thereof, or any weeds, in accordance with the provisions of this <br />chapter, the Director of Public Service is herebx authorized and it shall be his duty to <br />enforce the provisions of this chapter, to cause such tree, lawn, grass, plant or shrubbery, <br />or part thereof, to be trimmed or removed, and to cut and remove all weeds." <br />SECTION 2: That any ordinance, or part of ordinance, in conflict or inconsistent <br />with this Ordinance, is, to the extent of any such conflict or inconsistency, repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reason that it is necessary that this Ordinance go into effect immediately so <br />that the City may more effectively control nuisance growth of gass and weeds in the City <br />which adversely afFect the health and safety of residents, and further provided it receives <br />the affirmative vote of two-thirds of all members of Council, it shall take effect and be in <br />force immediately upon its passage and approval by the Mayor. <br />PASSED: <br />?? <br />AT T.• <br />i? <br />L.
