<br />SECITON 3: That there be and is hereby created new Section 1359.08 of the
<br />Building Code, entitled ""T^fifie°fien__&f Information to be Provided Regarding
<br />Unoccupied Commercial Building", which shall read in its entirety as follows:
<br />1359.08 INFORMATI4N TO BE PROVIDED
<br />REGARDING UNOCCUPIED COMMERCIAL BUILDING.
<br />Upon receiving information that the Building Commissioner has issued a
<br />notice to correct or abate pursuant to Section 1359.06 of this Chapter to the owner
<br />of an unoccupied commercial building, the Director of Public Safety shall
<br />immerliately in writing netify the awner that, wit6ia three business days, be mast
<br />provide the City in writing with such information as may be required by the
<br />Buitding eommissioner for ttre praper enforcement of this Chapter, as wetl as any
<br />other information deemed necessary for the proper administration of this Title,
<br />including the following information:
<br />1. Name, address and telephone number of owner (other than property
<br />address);
<br />2. Name, address and telephone number of property manager or custodian;
<br />3. Name, address and telephone number of real estate agent or other
<br />representatives;
<br />4. Name, address and telephone number of landscape service company;
<br />5. Emergency contact information in addition to the above.

<br />SECTION 4: That there be and is hereby created new Section 1359.09 of the
<br />Building Code, entitled "Property Maintenance Bond", which shall read in its entirety as
<br />follows:
<br />1359.09 PROPERTY MAINTENANCE BOND
<br />(a) The owner shall in all cases be responsible for performing and liable for all
<br />costs associated with or expenses incurred to maintain the unoccupied building and
<br />premises following its vacancy and pursuant to the requirements of this chapter. Within
<br />t6ree business days after receiving a notice from the Director of Public Safety as set
<br />forth in Section 1359.08 above, the owner of any unoccupied commercial building shall
<br />guarantee such maintenance by posting a cash bond or negotiable securities in the amount
<br />of One Thousand Dollars ($1,000.00), which shall be subject to the procedure herein.
<br />The Property Maintenance Bond shall remain at the disposal of the Director of Public
<br />Safety, while the building remains unoccupied, to provide payment for such maintenance,
<br />abatement of any nuisance or to remedy any violation of this chapter pursuant to Section
<br />13 59.06. The ten-day notice to correct and abate as required by § 13 59.06 shall include a
<br />warning that, if the owner fails to comply, the owner's bond shall be expended to correct
<br />or abate the violation.
