r CITY OF NORTH OLMSTED RESOLUTION NO. 2003 - 76 BY: Mayor Musial. A RESOLUTIONAUTHORIZING THE PAYMENT OF THIRTEEN THOIISAND DOLLARS ($13, 000. 00) TO THE NORTH OLMSTED FIREFIGHTERS, IAFF LOCAL 1267 FOR DISTRIBUTION TO SPECIFIC OFFICERS OF THE NOFD AND IN CONSIDERATION OF THE SETTLEMENT OF GRIEVANCES UNDER THE COLLECTIVE BARGAINING AGREEMENT AND DECLARING AN EMERGENCY. WHEREAS, the North Olmsted Firefighter, IAFF Local 1267, has filed, on behalf of its membership in the North Olmsted Fire Department, a grievance pursuant to the Collective Bazgaining Agreement (CBA) regarding the availability of orthodontic care (past and present) pursuant to the dental plan, which grievance is presently awaiting arbitration; and N'HEREAS, the Mayor and his designees have, on behalf of the Administration, through the process of investigation and negotiation, following the denial of said grievance but prior to arbitration, proposed to resolve the grievance claims by offering to bargain unit members enrollment in a different dental plan, which includes orthodontic coverage, available through AFSCME Care and by reimbursing certain bargaining unit members for orthodorrtic expenses incurred prior to the filing of the grievance in the amount of Thirteen Thousand Dollars ($13,000.00); and WHEREA.S, the costs saved through enrollrnent in AFSCME Caze Plan, together with the arbitration costs saved by foregoing further hearings on these grievance, will more than equal the settlement amount over time, not to mention the intangible benefit of positive labor relations; and WHEREAS, it is the desire of this Council to authorize the Director of Finance to pay to the North Olmsted Firefighters, IAFF Local 1267, by and for distribution to certain, identified bargaining unit members of the NOFD, the sum of Thirteen Thousand Dollars ($13, 000.00). NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor of the City of North Olmsted be, and he hereby is, authorized and directed to sign and thereby enter into a Settlement Agreement between the City and the North Olmsted Firefighters, IAFF Loca1 1267, in form and substance as identified in the attached Settlement Agreement between the City and the said Firefighters, a copy of which is attached as Exhibit l, together with or as well as the Memorandum of Understanding included therein, and in consideration for the settlement and withdrawal of the pending grievance under the CBA.
