£ <br />Ordinance No. 2003-70 <br />Page 2 <br /> <br />5ECTION 2: That therG be and hereby is created an amended Section 950.02 of <br />Chapter 950 of the Streets, Utilities and Public Services Code of the City of North <br />Olmsted, which is presently entitled "DUTIES AND POWERS OF CITY FORESTER." <br />Said amended Section 950.02 shall be amended to provide in form and substance as set <br />forth below, which displays and differentiates between the existing and proposed <br />regulations, and which shall henceforth read upon adoption as follows: <br />950.02 DUTIES AND POWERS UF CITY FORESTER <br />The City Forester shall be vested with the following duties and powers: <br />(a) Ta enforce or cause to be enforced the provisions of this chapter. <br />(b) To enforce arboricultural specifications and standards of practice generally <br />accepted by the arboriculture trade, which shall govern the selection, <br />planting, maintenance, production and removal of public, commercial and <br />multi-family residential trees and utilization of wood and forest products <br />produced in the course of operation. <br />(c) To issue orders and pernuts for planting, maintenance, protection and <br />removal of public, commercial and multi-family residential trees and, <br />where applicable, to make site inspections and enforce conditions <br />imposed upon Landscaping Plans and/or upon Tree Preservation/ <br />Removal Permits iasued pursuaat to this Chapter and as otherwise <br />imposed upon development plans and commercixl building permits <br />pursuant to Chapter 1126. <br />(d) To review and report on Tree Preservation/Removal Plans and other <br />Landscaping Plans to t6e Architectural Review Board; to conduct site <br />inspections, when necessary, prior to such administrative review and <br />permit approval; and to deliver reports, advice and recommendations <br />to administrative bodies consistent with the standards imposed 6erein. <br />(e) To plant, maintain and remove trees on City owned property and to <br />monitor the maintenance of trees around utility lines. To survey and <br />appraise the condition of trees located on City owned property and <br />public rights of way. To notify contiguous property owners prior to <br />the removal or planting of any tree within the municipal right of way. <br />SECTION 3: That this legislation is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reason that it is necessary that this legislation go into effect immediately in <br />order that trees, which are a City resource, may be protected in time for the start of the <br />construction season, and further provided it receives the affirmative vote of two-thirds of <br />all members of Council, it sha11 take effect and be in force immediately upon its passage <br />by Council and approval by the Mayor. <br />
