To require that any and all tree preservation/removal and other <br />landscaping plans be presented in conjunction with the application for a <br />tree removal permit and to further require that same be submitted prior to <br />and then incorporated into a11 proceedings before Architectural Review <br />Board pursuant to Chapter 1126 or other site development considerations; <br />2. To adopt and enforce an administrative fee schedule which will enable the <br />City Forester to provide consultation services and advice to developers on <br />the subject of Urban Forestry, including the review and recommendation <br />on all tree preservation/removal and other landscaping plans submitted <br />pursuant to Chapter 950, and which will also enable said City Forester to <br />report to the Architectural Review Board; <br />3. To integrate the review procedures for granting Tree Removal and <br />Building Permits so that, in the case of new developments, the Tree <br />Removal permit is wholly dependent upon and only issued in conjunction <br />with or upon the administrative approval of development plans; <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 950.03, which presently reads as follows, shall be amended <br />as hereinafter provided in Section 2: <br />950.03 PERMITS REQUIRED. <br />(a) No person sha11 plant or remove any public, commercial or multi-family <br />residential tree in a treelawn or other public, commercial or multi-family residential place <br />without first procuring a permit from the City Forester. The person receiving the permit <br />shall abide by azboricultural specificaxion and standards af practice generally accepted by <br />the arboriculture trade. <br />(b) No person shall make any excavation, place any fill, compact soil, or construct <br />any building, structure, street, sidewalk, driveway, pavement or public utility within the <br />dripline of any public, commercial or multi-family residential tree without first obtaining <br />a permit for such work. As condition of issuing such permit, the City Forester shall <br />require that the work be done in accordance with such generally accepted arboricultural <br />methods as may be necessary to protect the vitality of such trees. <br />(c) Application for permits sha11 be made at the office of the City Forester no less <br />than five days in advance of the time the work is to be done. In case of emergency, the <br />City Forester may waive this requirement. There shall be no cost for such permits. <br />(d) All departments of the City shall be exempt from these permit provisions <br />subject only to the notification af City Forester of any construction project that will affect <br />any public, commercial or multi-family residential trees. <br />(e) No permit shall issue to remove any commercial or multi-family residential <br />tree from a commercial or multi-family residential place, unless: <br />(1) With respect to a vacant or undeveloped lot, the owner or his designee <br />has first presented to the City Planning Commission, pursuant to <br />Section 1217.08 of the Planning and Zoning Code a drawing or <br />rendering setting forth his landscaping proposal for such lot, and such <br />proposal has been accepted by the Planning Commission; and <br />
