<br />Ordinance No. 2003-69 <br />Page 4 <br />. Eacept for new plantings of trees on eaisting <br />developments, tThere shall be a nonrefundable perniit fee in the amount of Fifty <br />Dollars ($54.00) for multi-family reaidential and One Hundred Dollars ($100.00) for <br />commercial, as may be amended based upon the schedule of fees as determined by <br />Council, from time to time. The fee assessed shall be reflective of the administrative <br />costs incurred by the City in relation to the City Forester's role in review of plans, <br />inspection of site conditions and reports generated for pu6lic meetings. <br />(d) All depaztments of the City shall be exempt from these permit provisions <br />subject only to the notification of City Forester of any construction praject that will affect <br />any public, commercial or multi-family residential trees. <br />(e) No permit sha11 issue to remove any commercial or multi-family residential <br />tree from a commercial or multi-family residential place, unless: <br />(1) With respect to a vacant or undeveloped lot, the owner or his designee <br />has first presented to the Arc6itectural Review Board Ei1y PI&Rfling <br />Eefnfnissien, pursuant to Section 1217-08 1126.04(d) of the Planning <br />and Zoning Code a drawing or rendering setting forth his Tree <br />Preservation/Removal and other landscaping proposal for such lot, <br />and such proposal has been accepted by the Planning Commission; and <br />(2) With respect to a developed lot, the owner or designee obtains from <br />the City Building Commissioner written notice that the prvposed <br />removal does not violate or conflict with any Tree <br />PreservationlRemoval or other landscaping plan previously <br />approved by the City for such lot, pursuant to the applicable provisions <br />of the Zoning Ordinance. <br />(3) With respect to any lot being developed, redeveloped or otherwise <br />modifed pursuant to Chapter 1126 or any other Chapter of the <br />Plaaning and Zoning Code, t6at the Tree Preservation/Removal <br />and other Landscaping Plans be evaluated by the City Forester, <br />and then subject to the review and approval of the Architectural <br />Review Board, prior to the issuance of said Tree Removal Permit. <br />(4) The AppGcant has fully complitd with the Tree Preservation & <br />Replacement Program, including the payment of any applicable <br />fees, prior to the issuance of a Tree Removal permit. <br />SECTION 3: That this legislation is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and <br />for the further reasan that it is necessary that this legislation go into effect immediately in <br />order that trees, which are a City resource, may be protected in time for the start of the <br />construction season, and further provided it receives the affirmative vote of two-thirds of <br />all members of Council, it shall take effect and be in force immediately upon its passage <br />by Council and approval by the Mayor. <br />.
