CITY OF NORTH OLMSTED ORDINANCE NO. 2003 - 62 BY: Mayor Norman T. Musial AN ORDINANCE ACCEPTING A WATER MAIN EASEMENT LOCATED ON PROPERTY OWNED BY CAPITAL HILL DEVELOPMENT CO. AND DESIGNATED AS PERMANENT PARCEL NO. 231-19-017 ON THE CUYAHOGA COUNTY MAPS AND RECORDS, IN CONNECTION WITH THE WATER MAIN SUPPLYING WATER SERVICE FOR ROSEWOOD CLUSTERS, AND DECLARING AN EMERGENCY. WhfEREAS, Capital Hill Development Co. has offered an easement for a water main to the City of North Olmsted for the purpose of maintaining water supply service; and WHEREAS, this Council desires to obtain from said owner a permanent easement for water main purposes in order to a11ow the City to control access to and/or maintain the water main and appurtenances on said property known as Permanent Parcel No. 231-19-017; and WHEREAS, although this water main is intended to supply service within the City of Westlake, this water main is described as a distribution main pursuant to the master Water Services Agreement with the City of Cleveland approved by Council by Ordinance No. 83-49 and, as this water main is an integral part of and/or connected to said utility, this Council intends to accept this Easement in accordance and compliance with said Water Services Agreement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCII. OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor is hereby authorized and directed to accept, on behalf of the City of North Olmsted, a water main easement from Capita.l Hill Development Co., the owner of certain real property located at 3690 Columbia Raad and known as Permanent Parcel No. 231-19-017. A copy of said Easement, which the Mayor is authorized and directed to accept on behalf of the City, is attached as Exhibit A and made a part hereof as though fully rewritten herein. SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause said easement to be recorded in the office of the Cuyahoga County Records. SECTION 3: That this Ordinance is hereby declared to be an emergency measwe immediately necessary for the preservation of the public peace, health, safety and welfaze of the City, and for the further reason that it is immediately necessary to obtain said water main easement and provided that it receives the affirmative vote of two-thirds of all members of Council, it sha11 take effect and be in force immediately upon its passage and approval by the Mayor.
