? <br />Resolutian No. 2003-60 <br />Page 2 <br />SECTION 1: That the Mayor be and he hereby is authorized to terminate the contract <br />between the City and Carron Asphalt Paving, Inc. ["Casron"], which had provided for Carron to <br />construct new tennis courts at the North Olmsted Park, and to pay Carron, upon receiving a <br />proper release, the sum of $11,081.00 for att work performed by Carron under said comract. <br />SECTION 2: That the Director of Finance is authorized to pay to Carron Asphalt <br />Paving, Inc., upon submittal of a claim for payment in proper form and approved by the Director <br />of Public Safety, and a release executed by Carron Asphalt Paving, Inc. and approved by the <br />Director of Law, the sum of $11,081.00 for a11 work performed by Carron under said contract. <br />SECTIQN 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is necessary that this Resolution immediately go into effect because the <br />contractor has had a claim pending with the City since late 2002 and must be paid as soon as <br />possible to avoid litigation, and fiurther provided it receives the affirmative vote of twathirds of <br />the members of this Council, it shall take effect and be in force immediately upon its approval by <br />the Mayor. <br />,-` <br />PASSED: 00 3 <br />ATTEST.- <br />L.
