Resolution No. 2003-26 SECTION 1: That the Mayor be and he hereby is authorized, upon approval of the Board of Control, if necessary, to enter into a contract with Professional Service Industries, Inc. ("PSI") to provide Earthwork subgrade and struct fill inspection and testing services, and Hot mix Asphalt Paving Subgrade and Asphalt inspection and testing services, which contract sha11 nat involve an expenditure in excess vf Five Thousand Doila.rs',($S,OOfl.00) and shall be in substantially the form as the Agreement attached to this Resolution as Exhibit A, with only such changes to be hereinafter made as are not substantially adverse to the City and which are approved by both the Mayor and the Director of Law. The character of any such changes as not being substantially adverse to the City sha11 be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law. SECTION 2: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public peace, health, safety and welfare, of'this City, and for the further reason that this legislation is required to be immediately effective so that testing and inspection services can be timely made and to enable the City to timely complete the construction phase of the New North Olmsted Branch Library; and further provided it receives the affirmative vote of two-thirds of all members of Council, it sha11 take effect and be in force immediately upon its passage and approval by the Mayor. ., i PASSED: VL'?-e-l 4 , C?00 3 -?- AT ST.i ? f ?- L 3'Y1.GUVt?-?
