?. . <br />CITY OF NORTH OLMSTED <br />RESOLUTION NO. 2003 - 9 <br />BY: Mayor Musial <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC <br />SERVICE TO RECEIVE PROPOSALS AND AUTHORIZING THE <br />MAYOR TO ENTER INTO AN AGREEMENT FOR THE DESIGN <br />AND PREPARATION OF DRAWINGS FOR THE REPAIR OF <br />THE BRADLEY ROAD AND WIIVDSOR DRIVE CULVERTS, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, as a result of bridge inspections conducted by the County in the year <br />2002 and the State in the year 2001, it has been determined by the City Engineer that the <br />Bradley Road and Windsor Drive culverts are structures rated 5 which require immediate <br />attention and repair; and <br />WHEREAS, consistent with the City Engineer's recommendation, it is the desire of <br />this Council to authorize the Director of Public Service to receive proposals from professional <br />design firms, and the Mayor to enter into an agreement with a professional design firm, to <br />design and prepare drawings for the required repairs to the Bradley Road and Windsor Drive <br />Culverts; <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OffiO: <br />SECTION 1: That the Director of Public Service be and is hereby authorized to <br />receive proposals from professional design firms for the design and prepaxation of drawings for <br />the repairs required to the Bradley Road and Windsor Drive culverts, consistent with the <br />December 2002 Braddey Road and Windsor Drive Culvert Rehabilitation Request for <br />Proposal: Professional Design Services, attached to this Resolution as "Exhibit A." <br />SECTION 2: That, upon approval of the Board of Control, the Mayor be and is <br />hereby authorized to enter into an agreement in an amount not to exceed Thirty-Eight <br />Thousand Dollars ($38,000) with the professional design firm that submits the proposal which <br />renders it most qualified, in the judgment of the Board of Control, to perform the required <br />professional design services at a compensation which is fair and reasonable to the City. Said <br />agreement sha11 be in accordance with the form contract attached to this Resolution as "Exhibit <br />B," with only such changes therein as are not substantially adverse to the City and which are <br />approved by both the Mayor and the Director of Law. The character of any such changes as <br />not being substantially adverse to the City shall be evidenced conclusively by the execution of <br />the agreement by the Mayor and the approval of the agreement by the Director of Law. <br />
