Any payment not received within sixty (60) calendar-days of the scheduled payment date may, at the option of Consultant, result in a de facto notice of i termination from Client and shall cause the provisions of section 11.3 herein to beinvoked. ? 11,1.8 The efforts proposed herein may, upon authorization of Client, require the , performance of research, studies, surveys, frequency allocation searches, applications for frequency assignments, feasibility studies, negotiations with a ? third party(ies), technical appraisals, facilities and/or performance evaluations, and similar efforts on behalf of Client. Client shall agree to honor in a timely ? manner any and all invoices proposed herein notwithstanding the reported ? discoveries, outcomes, conclusions, or opinions presented by Consultant as a result of the performance of such authonzed studies or research efforts. ? 11.1.9 The terms and conditions offered herein are predicated upon the ability of ? Consultant to maintain and regulate work schedules and manpower deployment on behaif of Client in an orderly, efficient, and systematic manner. Any and all ? fixed-fees, not-to-exceed fees, and hourly fees quated herein have therefore been established by Consultant on the basis of regulated and orderly manpower ? scheduling. By acceptance of this offering, Client therefore agrees to accept an hourly fee premium of fifty percent (50%) for any excess man-hours incurred by ? Consultant as a result of fulfilling any Client request for any expedited services or project completion times. ? Services involving premium fees must be authorized in writzng by the client's ?
