THE C1TY OF NORTH OLMSTED <br />ORDINANCE NO. 95-150 <br />BY: Mayor Edward Boyle <br />AN ORDINANCE AMENDING TBE CITY OF NORTH OLMSTED <br />CODIFIED ORDINANCES SECTION 947.01 ENTITLED "RULES <br />AND REGULATIONS," IN ORDER TO PERMIT TBE CITY TO <br />ENTER INTO A CONCESSION AGREEMENT FOR TIIE PURPOSE <br />OF SELLING FOOD AND NON-ALCOHOLIC BEVERAGES IN CITY <br />PARKS AND TO PERMIT, THROUGH EXPRESS WRITTEN <br />PERNIISSION OF THE CITY, NONPROFIT GROUPS OR <br />ORGA1vIZATIONS TO ENTER INTO CONCESSION AGREEMENTS <br />FOR TIAE PURPOSE OF SELLING FOOD AND NON-ALCOHOLIC <br />BEVERAGES IN CITY PARKS FOR LIlVIITED SPECIAL EVENTS, <br />WITH TTiE EXCEPTION OF TIAE ANNUAL HOMECOMNG <br />WHICH WII.,L REQUIltE NO CONCESSION PERNIIT AS <br />MANDATED IN THIS ORDINANCE, AS AMENDED. <br />WHEREAS, this Council has recognized the need to provide improved concession <br />services to better serve the community at the City parks through a contractual arrangement <br />with a private vendor, and; <br />WHEREAS, this Council has recognized that such an arrangement would provide <br />additional revenue to be earmarked specifically for the acquisition of certain necessary park <br />amenities for the continued enhancement of the City parks and for the enjoyment of the entire <br />community, and; <br />WHEREAS, this Council has recognized the need to provide nonprofit groups or <br />organization within the City of North Olmsted with a means of requesting the City's approval <br />for concession service arrangements for special events held 'm City parks for the enjoyment of <br />all event participants. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO; <br />Section 1. That Section 947.01 (b), which presently reads: <br />"Selling Merchandise. No person, partnership or corporation operating for <br />profit exclusive and apart from a nonprofit group or organization shall sell or offer <br />for sale any goods, wares, merchandise or services in the City parks." <br />be and the same is amended and, as amended, shall read as follows: <br />
