CITY OF NORTH OLMSTED ORDINANCE NO. 93-117 By: Paul Miller, Councilman at Large AN ORDINANCE AMENDING SECTION 741.03 OF CHAPTER 741, ENTITZED "DELIVERIES TO COMMERCIAL ESTABLISHMENTS, " OF THE BUSINESS REGULATION CODE OF THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, it is the desire of this Council to amend section 741.03 of chapter 741 of the Business Regulation Code, in order to require owners and tenants of commercial property located within 250 feet of residential buildings to post appropriate signs alerting truck drivers to prohibitions against deliveries during certain hours, and prohibitions against running engines while making deliveries; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECT70N1: That Section 741.03, entitled "Prohibitions," of Chapter 741 of the Business Regulation Code, which presently reads as follows: 741.03 PROHIBITIONS. (a) No person shall deliver or cause to be delivered, or accept delivery of, any goods or merchandise to or at a commercial establishment within 250 feet of a residendal building between the hours of 11:00 p.m. and 7:00 a.m. (b) No person making deliveries or receiving deliveries at any time sha11 permit the engine of a motor vehicle to remain running for more than ten minutes while waiting to make or receive deliveries. be amended, and as amended, sha11 read as follows: 741.03 PROHIBITIONS. (a) No person shall deliver or cause to be delivered, or accept delivery of, any goods or merchandise to or at a commercial establishment within 250 feet of a residential building between the hours of I1:00 p.m. and 7:00 a.m. (b) No person making deliveries or receiving deliveries at any time shall permit the engine of a motor vehicle to remain running for more than ten minutes while waiting to make or receive deliveries between 11:00 p.m. and 7:00 a.m.
