CITY OF NORTH OLMSTED <br />ORDINANCE NO. 93-117 <br />By: Paul Miller, Councilman at Large <br />AN ORDINANCE AMENDING SECTION 741.03 OF CHAPTER <br />741, ENTITZED "DELIVERIES TO COMMERCIAL <br />ESTABLISHMENTS, " OF THE BUSINESS REGULATION <br />CODE OF THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, it is the desire of this Council to amend section 741.03 of chapter 741 of the <br />Business Regulation Code, in order to require owners and tenants of commercial property located <br />within 250 feet of residential buildings to post appropriate signs alerting truck drivers to <br />prohibitions against deliveries during certain hours, and prohibitions against running engines while <br />making deliveries; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECT70N1: That Section 741.03, entitled "Prohibitions," of Chapter 741 of the Business <br />Regulation Code, which presently reads as follows: <br />741.03 PROHIBITIONS. <br />(a) No person shall deliver or cause to be delivered, or accept delivery of, any goods or <br />merchandise to or at a commercial establishment within 250 feet of a residendal building between <br />the hours of 11:00 p.m. and 7:00 a.m. <br />(b) No person making deliveries or receiving deliveries at any time sha11 permit the engine of a <br />motor vehicle to remain running for more than ten minutes while waiting to make or receive <br />deliveries. <br />be amended, and as amended, sha11 read as follows: <br />741.03 PROHIBITIONS. <br />(a) No person shall deliver or cause to be delivered, or accept delivery of, any goods or <br />merchandise to or at a commercial establishment within 250 feet of a residential building <br />between the hours of I1:00 p.m. and 7:00 a.m. <br />(b) No person making deliveries or receiving deliveries at any time shall permit the engine of <br />a motor vehicle to remain running for more than ten minutes while waiting to make or receive <br />deliveries between 11:00 p.m. and 7:00 a.m. <br />
