CITY OF NORTH OLMSTED ORDINANCE NO. 95- 95 By: Mayor Edward Boyle AN ORDINANCE REPEALING ORDINANCE NO. 94-184 WHICH HAD AUTHORIZED THE ANNEXATION OF CERTAIN UNINCORPORATED TERRITORY LOCATED IN OLMSTED TOWNSHIP TO THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS, this Council on January 17, 1995 passed Ordinance No. 94-184, which authorized the annexation of a certain portion of Olmsted Township to the City of North Olmsted and authorized the Director of Law to pursue legal measures to effectuate such annexation; and WHEREAS, according to law, the issue of such annexation is scheduled to be put before the voters of Olmsted Township at the November, 1995 election; and WHEREAS, upon further consideration, the Mayor and this Council have determined that it is proper and fitting to repeal said Ordinance on the annexation issue, and cause the removal of such issue from the November, 1995 ballot. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Ordinance No. 94-184, which is attacheri hereto and incorporated herein by reference, be and hereby is expressly repealed. SECTION 2: That the Clerk of Council is authorized and directed to forward a certified copy of this Ordinance, immediately upon its passage and approval, to the Cuyahoga County Board of Commissioners and to the Cuyahoga County Board of Elections. SECTION 3: That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were held in an open meeting of this Council, and that all deliberations of this Council and any of its committees that resulted in such formal actions were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code. SECTION 4: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare and further provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
