CITY OF NORTH OLMSTED <br />ORDINANCE NO. 95- 95 <br />By: Mayor Edward Boyle <br />AN ORDINANCE REPEALING ORDINANCE NO. <br />94-184 WHICH HAD AUTHORIZED THE ANNEXATION <br />OF CERTAIN UNINCORPORATED TERRITORY <br />LOCATED IN OLMSTED TOWNSHIP TO THE CITY OF <br />NORTH OLMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council on January 17, 1995 passed Ordinance No. 94-184, which <br />authorized the annexation of a certain portion of Olmsted Township to the City of North Olmsted <br />and authorized the Director of Law to pursue legal measures to effectuate such annexation; and <br />WHEREAS, according to law, the issue of such annexation is scheduled to be put before <br />the voters of Olmsted Township at the November, 1995 election; and <br />WHEREAS, upon further consideration, the Mayor and this Council have determined that <br />it is proper and fitting to repeal said Ordinance on the annexation issue, and cause the removal <br />of such issue from the November, 1995 ballot. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Ordinance No. 94-184, which is attacheri hereto and incorporated <br />herein by reference, be and hereby is expressly repealed. <br />SECTION 2: That the Clerk of Council is authorized and directed to forward a certified <br />copy of this Ordinance, immediately upon its passage and approval, to the Cuyahoga County <br />Board of Commissioners and to the Cuyahoga County Board of Elections. <br />SECTION 3: That it is found and determined that all formal actions of this Council <br />concerning and relating to the adoption of this Ordinance were held in an open meeting of this <br />Council, and that all deliberations of this Council and any of its committees that resulted in such <br />formal actions were in meetings open to the public, in compliance with all legal requirements, <br />including Section 121.22 of the Ohio Revised Code. <br />SECTION 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and further <br />provided that it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor. <br />
