CITY OF NORTH OLMSTED ORDINANCE NO. 95- 92 BY: Councilwoman Janet Saringer AN ORDINANCE GRANTING THE OHIO BELL TELEPHONE COMPANY A PERPETUAL RIGHT OF WAY AND EASEMENT WITHIN PERMANENT PARCEL NO. 232-12-010 OWNED BY THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, IN ORDER TO 1NSTALL, CONSTRUCT, RE-CONSTRUCT, OPERATE, MAINTAIN, REPAIR, SUPPLEMENT AND REMOVE A CONTROLLED ENVIRONMENT VAULT TO PROVIDE ADDITIONAL ENVIRONMENTAL PROTECTION, AND DECLARING AN EMERGENCY. WHEREAS, the City of North Olmsted owns and maintains Permanent Parcel No.232-12-010, as recorded by plat filed in Volume 42948 Page 657 of Cuyahoga County Map Records, and WHEREAS, it is necessary for the Ohio Bell Telephone Company to install a controlled environment vault in order to provide additional environmental protection, on property owned by the City of North Olmsted. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That this Council does hereby authorize the Mayor to execute the easement agreement granting the Ohio Bell Telephone Company easement rights over the parcel of land as more fully described in a copy of said easement agreement marked Exhibit "A-1" and made a part hereof as though fully rewritten herein. SECTION 2: That the Engineering Department of the City of North Olmsted is hereby directed to cause said easement to be recorded in the office of the Cuyahoga County Recorder. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary to cause the executed easement to be recorded, and further provided it receives the affirmative vote of two- thirds of all members of Council, it shall take effect and be in force upon its passage and approval by the Mayor. .
