3. That ODOT will review the construction plans for conformance with this section <br />of this Ordinance and make an inspection of the completed project. <br />SECTION 3: That the Municipality hereby agrees to participate with ODOT in the cost <br />of the improvements as follows: <br />1. That ODOT shall contribute Eighty Percent (80%) of the cost of construction of <br />the above described improvements and One Hundred Percent (100%) of <br />construction supervision and contract administration. <br />2. Within the corporate limits of the Municipality, the Municipality shall contribute <br />Twenty Percent (20%) of the cost of construction of the above described <br />improvements and One Hundred Percent (100%) of the cost of engineering. <br />SECTION 4: That upon completion of said improvement, said Municipality will <br />thereafter keep said highway open to traffic at all times, and <br />1. Maintain the improvement in accordance with the provisions of the statutes <br />relating thereto and make ample financial provisions for such maintenance; <br />and <br />2. Maintain the right-of-way and keep it free of obstructions in a manner <br />satisfactory to ODOT and hold said right-of-way inviolate for public highway <br />purposes and permit no signs, posters, billboards, roadside stands or other <br />private installations within the right-of-way limits. <br />SECTION 5: That the Mayor is further authorized to enter into any agreements with <br />ODOT as may be necessary and appropriate for the planning and construction of this <br />improvement in conjunction with the recommendations of the City Engineer, and <br />approved as to form by the City Law Director, in accordance with all authority granted to <br />and limitations upon by the City Director of Finance. <br />SECTION 6• That this Ordinance is hereby declared to be an emergency measure by <br />reason of the need to submit the application for consideration by NOACO and ODOT, and <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />take effect and be in force immediately upon its passage and approval by the Mayor; <br />otherwise it shall take effect and be in force from and after the earliest period allowed by <br />law. <br />
