# <br />/ <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 95-48 <br />By: George Nasher <br />AN ORDINANCE AUTHORIZING THE MAYOR TO SUBMIT AN <br />APPLICATION TO THE NORTHEAST OHIO AREAWIDE <br />COORDINATING AGENCY FOR THE CITY TO PARTICIPATE <br />IN THE STATE TRANSPORTATION ENHANCEMENT PROGRAM <br />FOR THE CONSTRUCTION OF MOUNDING AND LANDSCAPING <br />ALONG A PORTION OF THE PROPOSED CROCKER ROAD IN <br />NORTH OLMSTED, AGREEING TO SHARE IN THE PROJECT <br />COST, AGREEING TO THE FUTURE MAINTENANCE OF SAID <br />IMPROVEMENTS, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the Intermodal Surface Transportation Act of 1991, the Ohio <br />Departrnent of Transportation, hereinafter referred to as ODOT, is authorized to establish <br />and administer the Transportation Enhancement Program for the benefit of Municipalities <br />by providing for improvements, beyond the customary improvements, when developing a <br />transportation project, and <br />WHEREAS, the northeast Ohio Areawide Coordinating Agency, herinafter referred to as <br />NOACA, is authorized to accept and evaluate applications from Municipalities in <br />Cuyahoga County for participation in the Transportation Enhancement Program, and <br />WHEREAS, The City of North Olmsted, hereinafter referred to as the Municipality, <br />requests the cooperation of ODOT in the construction of mounding and landscaping along <br />a portion of the proposed Crocker Road in the City of North Olmsted. <br />NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OHIO: <br />SECTION 1: That the Mayor is hereby authorized to submit and apply to NOACA for <br />the Municipality to participate in the Transportation Enhancement Program administered <br />by ODOT for the construction of mounding and landscaping along a portion of the <br />proposed Crocker Road in the Municipality. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure by <br />reason of the need to submit the application for consideration by NOACA and ODOT, and <br />provided it receives the affirmative vote of two-thirds of all members of Council, it shall <br />
