CTTY OF NORTH OLMSTED <br />RESOLUTION NO. 95-32 <br />BY: Mayor Edward Boyle <br />A RESOLU770N AUITHORIZING AND DIRECTING THE <br />MAYOR OF THE CTIY OF NORTH OLMSTED TO SIGN ON <br />BEHALF OF THE CITY OF NORTH OLMSTED, A CONSENT <br />DF,C'REE WITH THE UNTIED STATES OFAMERICA (USEPA) <br />AND THE STATE OF OHIO FOR THE PURPOSE OF <br />SETTZING PAST DISPUlES FROM THE YEAR 1988 TO THE <br />PRESENT, DEALING WITH NON-COMPLIANCE WITH <br />PERMIT LIMITATIONS, AS N'F.LL AS VIOLATIONS FOR <br />OVER-FLOWS AND BY-PASSES AT THE SEWAGE <br />TREATMENT PLANT WITHIN THE CITY OF NORTH <br />OMSTED, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Director of Law as well as other administrative officials, including the <br />Mayor have, for the past several years, been working with the USEPA regarding violations of <br />pennit limitations as well as violations for by-passes and over-flows at the North Olmsted sewage <br />treatment faeilities; and <br />.WHEREAS, the initial exposure for fines because of the aforesaid violations could well <br />have reached 36 million dollars when applying the standard rules for fines that are levied for <br />pernut violations and over-flows and by-passes; and <br />WHEREAS, through the negotiation process, the Director of Law, Mayor and Service <br />Director have convinced the U.S. Attomey's office, as well as the USEPA and the Ohio EPA, <br />that the City has made every effort from 1990 to date to con'ect all problems associated with <br />failure to meet pernut limitations as well as causes for over-flows and by-passes; and <br />WHEREAS, after nearly two (2) yeazs of negotiations, a final agreement has been reached <br />regarding the resolution of past violations as aforesaid; and <br />WHEREAS, this Council has been advised in executive session throughout the period of <br />time as aforesaid regarding the progress of negotiations and has authorized the Director of Law <br />to negotiate a settlement of the claims proferred by the United States Government and the State <br />of Ohio. -
