CITY OF NORTH OLMSTED ORDINANCE NO. 95 -28 BY: Mayor Ed Boyle A ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF NORTH OLMSTED TO ENTER INTO AN AGREEMENT WITH MALCOLM PIItNIE, INC. TO PROVIDE ENGINEERING SERVICES PERTAINING TO OPERATIONAL CONSULTATION AND ASSISTANCE WITH RESPECT TO SEWER ' TRANSMISSIONS LINES AND THE WASTEWATER TREATMENT PLANT, INCLUDING ALL UTILITIES, NPDES PERMIT RENEWAL, AND NEGOTIATIONS WITH THE USEPA, OHIO EPA AND OHIO ENVIRONMENTAL BOARD OF REVIEW AND DECLARING AN EMERGENCY. WHEREAS, the Mayor has recommended that the services of the engineering firm of Malcolm Pimie, Inc. be hired to assist the City to accomplish aforesaid services due to their expertise in this field; and WHEREAS, upon the recommendation of the Mayor, this Council does hereby express its desire to have the Mayor enter into a contract with said form for and on behalf of the City. NOW, THEREFORE, BE IT RESOLVED BY TFE COUNCIL OF THE CITY OF NORTH OLMSTED,. COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an Agreement with Malcolm Pirnie, Inc. for the purpose of providing engineering services pertaining to operational consultation and assistance with respect to sewer transmission lines and the Wastewater Treatrnent Plant, including all utilities, NPDES Permit Renewal, and negotiations with the USEPA, Ohio EPA and Ohio Environmental Board of Review. SECTION 2: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is immediately necessary to proceed with the services and further provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
