CITY OF NORTH OLMSTED <br />ORDINANCE NO. 95 -28 <br />BY: Mayor Ed Boyle <br />A ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF <br />NORTH OLMSTED TO ENTER INTO AN AGREEMENT WITH MALCOLM PIItNIE, <br />INC. TO PROVIDE ENGINEERING SERVICES PERTAINING TO OPERATIONAL <br />CONSULTATION AND ASSISTANCE WITH RESPECT TO SEWER ' <br />TRANSMISSIONS LINES AND THE WASTEWATER TREATMENT PLANT, <br />INCLUDING ALL UTILITIES, NPDES PERMIT RENEWAL, AND NEGOTIATIONS <br />WITH THE USEPA, OHIO EPA AND OHIO ENVIRONMENTAL BOARD OF REVIEW <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the Mayor has recommended that the services of the engineering firm of <br />Malcolm Pimie, Inc. be hired to assist the City to accomplish aforesaid services due to their <br />expertise in this field; and <br />WHEREAS, upon the recommendation of the Mayor, this Council does hereby express <br />its desire to have the Mayor enter into a contract with said form for and on behalf of the City. <br />NOW, THEREFORE, BE IT RESOLVED BY TFE COUNCIL OF THE CITY OF NORTH <br />OLMSTED,. COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor be and he is hereby authorized and directed to enter into an <br />Agreement with Malcolm Pirnie, Inc. for the purpose of providing engineering services <br />pertaining to operational consultation and assistance with respect to sewer transmission lines and <br />the Wastewater Treatrnent Plant, including all utilities, NPDES Permit Renewal, and <br />negotiations with the USEPA, Ohio EPA and Ohio Environmental Board of Review. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for the <br />further reason that it is immediately necessary to proceed with the services and further provided <br />that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect <br />and be in force immediately upon its passage and approval by the Mayor. <br />
