Upon exhausting vacation, holidays and personal time, said employee will be required to <br />pay the Director of Finance one hundred (100%) percent of all expected cost or <br />premium cost for the purpose of continuing hospitalization benefits during the balance of <br />the leave of absence. <br />ARTICLE XVII <br />LEGALITY <br />17.1 It is the intent of the City and the OPBA that this Agreement comply in every <br />respect with applicable legal statutes and charter requirements. If it is determined that <br />any provisions of this Agreement are in conflict with any court of competent jurisdiction, <br />that provision shall be null and void and shall not affect the validity of the remaining <br />paragraphs of this Agreement. <br />17.2 Any past understanding, ordinance or resolution which has been in effect shall <br />remain in effect until such time that it is modified by a subsequent agreement. Such <br />modification shall be completed by the procedures set up in this Agreement for <br />negotiations. <br />17.3 It is the intent of the parties that this Agreement be interpreted as practicable as <br />possible in accordance with Chapter 4117 of the Ohio Revised Code. <br />ARTICLE XVIII <br />MANAGEMENT RIGHTS <br />18.1 Except as specifically limited herein, the City shall have the exclusive rights to <br />manage the operations, control the premises, direct the working force, and maintain <br />maximum efficiency of operations. Specifically, the City's exclusive management rights <br />include, but are not limited to, the sole right to hire, discipline and dischaxge for just <br />? cause, lay off and promote and demote; to promulgate and enforce reasonable <br />26 <br />C?
