<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 72-168 <br /> <br />AN ORDINANCE DETERMINING TO PROCEED <br />WITH THE CONSTRUCTION OF SIDEWALKS AT <br />CERTAIN LOCATIONS ON MARTIN DRIVE, LANSING <br />DRIVE, ORING DRIVE, NOREEN DRIVE, GARDENIA <br />DRIVE AND LOUANN DRIVE, AND DECLARING AN <br />EMERGENCY. <br />,BE IT ORDAINED by the Council of the City of North Olmsted, <br />Cuyahoga County, Ohio: <br />Section 1. That it <br />construction of concrete sidewalks <br />Lansing Drive, Oring Drive, Noreen <br />specified in Resolution No. 72-90, <br />owners did not construct sidewalks <br />resolution. <br />is hereby determined to proceed with the <br />at those locations on Martin Drive, <br />Drive, Gardenia Drive and Louann Drive, <br />adopted July 5, 1972, where the property <br />pursuant to the option oontained in said <br />Section 2. That said sidewalks shall be constructed in accordance <br />with the provisions of Resolution No. 72-90, adopted July 5, 1972, and with the <br />plans, specifications, estimates and profiles heretofore approved and now on <br />file in the office of the Clerk of Council. <br />Section 3. Subject to the provisions of•Section 727.24, Revised <br />Code, the Mayor of the City is hereby authorized and directed as soon as the <br />funds therefor are available to make and execute a contract for said improvement <br />with the lowest and best bidder after advertising according to law and the im- <br />provement shall be financed as provided in the resolution of necessity. <br />Section 4. The Clerk of Council is hereby directed to deliver a <br />certified copy of this ordinance to the County Auditor within fifteen days after <br />its passage. <br />Section 5. This Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, health and <br />safety of said City and for the further reason that the immediate construction <br />of said sidewalks is necessary to eliminate existing hazards to pedestrians <br />using said streets; WHEREFORE, this Ordinance shall be in full force and effect <br />from and immediately after its passage and approval by the Mayor. <br />PASSED: ~ I 'I1Z-- <br />ATTEST: <br />~~, ~ ~ <br />Nora T.
