<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- ~Glo <br />BY: ~_ <br /> <br />AN ORDINANCE AMEN DING SECTION 5 3 3.9 9 (d) OF <br />THE GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDINANCES ~ ENTITLED <br />" PENALTY " TO CONFORM TO CHANGES ENACTED BY <br />THE OHIO GENERAL ASSEMBLY, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Council has determined that it fs in the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted <br />by the Ohio General Assembly. <br />NOW; THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 533.99 (d ), Chapter 533 (Codified Ordinances ~ of <br />the North Olmsted General Offenses wading as follows <br />533.99 PENALTY. <br />(d) Whoever violates Section 533.07, 533.09 or 533.10 shall <br />be fined not more than. one thousand dollars ($1, 000) or <br />imprisoned not more than one year, or both. <br />be and the same is hereby amended to read as follows <br />533.99 PENALTY. <br />(d) Whoever violates Section 533.07, 533.09, 533.10, 533.11 (a ), <br />533.12 (a) or 533.13 shall be fined not more than one thousand <br />dollars ($1, 000) or imprisoned not more than one year, or both. <br />Section 2. That any ordinance or parts of ordinances, or resolutions or <br />parts of resolutions, inconsistent with the provisions of this Ordinance, are <br />hereby repealed, and especially Ordinance No. 72-143, with the effective date <br />of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 533.99 (d) prior to this <br />amendment is in conflict with the provisions of the State Statutes. WHEREFORE, <br />this Ordinance shall take effect and be in force immediately upon its passage, <br />otherwise, at the earliest period allowed by law. <br />PASSED: ~../.s~t...~ ~ /~ <br />ATTEST; <br />Nora T.
