<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- /~ .S~r <br /> <br />AN ORDiNAN CE ENACTING SECTION 5 33.13 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDINANCES } EN- <br />TITLED "PLACING HARMFUL SUBSTANCE OR OBJECTS <br />IN FOOD OR CONFECTION " TO CONFORM TO CHANGES <br />ENACTED BY THE OHIO GENERAL ASSEMBLY, AND DE- <br />CLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted <br />by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio <br />Sectionl. That Section 533.13, Chapter 533 (Codified Ordinances) of the <br />North Olmsted General Offenses shall read as follows : <br />533.13 PLACING HARMFUL SUBSTANCE OR OBJECTS IN FOOD OR <br />CONFECTION. <br />No person shall place pins, needles, razor blades, glass, <br />drug of abuse, or harmful or hazardous substance, or other <br />dangerous objects in any food or confection with intent to <br />harm the consumer or user thereof, nor shall any person <br />knowingly furnish any food or confection containing such <br />substances... or objects to another . The presence of any <br />such substances or object in any food or confection is prima- <br />facie ev~de~ce that such substance or object was intentionally <br />placed therein. (ORC 2901.45 ) <br />Section 2. That any ordinance or parts of ordinances, or resolutions or <br />parE~ of resolutions, inconsistent with the provisions of this Orti3nance, are here- <br />by repealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />me$sure necessary for the immediate preservation of the public peace, safety, <br />health and wel~fai~e by virtue of the fact that Section 533.13 prior to this amend- <br />ment is in conflict with the provisions of the State Statute's.
