<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- ~~~ <br />BY: / <br />`~ <br />.. ~~ <br />AN ORDINANCE ENACTING SECTION 537.99 (h ), (i ), <br />(j) and (k) OF THE GENERAL OFFENSES CODE OF THE <br />CTTY OF NORTH OLMSTED, OHIO, (CODIFIED ORDINANCES ) <br />ENTITLED "PENALTY " TO CONFORM TO CHANGES ENACTED <br />BY THE OHIO GENERAL ASSEMBLY, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted <br />by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That Section 5 3 7.9 9 , (h) , (i) , (j) and (k) (Codified <br />Ordinances) of the North Olmsted General Offenses shall read as follows <br />537.99 PENALTY. <br />(h) Whoever violates subsection (c) of Section 537.04 shall be <br />fined not more than five hundred dollars ($500.00) or imprisoned <br />not mare than six months, or both. <br />(i) If a violator of either Section 5 3 7. 12 or 5 3 7.21 i s charged and <br />proved to have been previously convicted, by a judgment which <br />has not been reversed or vacated, of a violation of either such <br />section or of an identical offense under a State Statute, then <br />such person shall be fined not more than five hundred dollars <br />( $500.00) and imprisoned not more than one year. A certified <br />copy of the judgment entry of conviction of such offense shall <br />be prima-facie evidence of any fact recited therein. <br />(j) For each subsequent violation of Section X37.13 after the first <br />conviction or plea of guilty for violation of this section, such <br />person shall be fined not more than five hundred dollars ($500.00 ) <br />or imprisoned not more than one year. <br />(k) Whoever violates Sections 537.19, 537.20 or 537.21 shall be fined <br />not more than three hundred dollars ($300.00) or imprisoned not <br />mare than ninety days, or both. <br />Section 2. That any ordinance or parts of ordinances, or resolutions or parts <br />of resolutions, inconsistent with the provisions of this Ordinance, are hereby re- <br />pealed with the effective date of this Ordinance. <br />Section 3.
