<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- ~7"'~ <br />BY: 6~~J <br />AN ORDINANCE ENACTING SECTION 537.21 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDINANCES a EN- <br />TITLED "SHOPLIFTING " TO CONFORM TO CHANGES <br />ENACTED BY THE OHIO GENERAL ASSEMBLY, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the bs~st interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted <br />by the Ohfo General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 537.21, Chapter 537 (Codified Ordinances) of the <br />North Olmsted General Offenses shall read as follows ; <br />537.21 SHOPLIFTING. <br />(a) No person shall willfully alter any label, price tags or marking <br />upon any merchandise offered for sale by any store or other <br />retail mercantile establishment with the intention of depriving <br />the owner of all or some part of the value thereof. <br />(b) No person shall willfully transfer any merchandise offered for <br />sale by any store or other retail mercantile establishment from <br />the container in or on which the same shall be displayed to any <br />other container with intent to deprive the owner of all or some <br />part of the value thereof . <br />(c) Who ever violates subsection (a) or (b) hereof is guilty of <br />shoplifting. (ORC 2907.48 ) <br />y <br />Section 2. That any ordinance or parts of ordinances, or resolutions or parts <br />of resolutions, inconsistent with the provisions of this Ordinance, are hereby re- <br />pealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safei~y , <br />health and welfare by virtue of the fact that Section 537. E1 prior to this amend- <br />ment is in conflict with the provisions of the State Statutes.
