<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- r~~ <br />BY: <br />~~. <br />AN ORDINANCE ENACTING SECTION 537.20 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDINANCES) EN- <br />TITLE "LARCENY BY TRICK " TO CONFROM TO <br />CHANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as exacted <br />by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 5 3 7.20 , Chapter 5 3 7 (Codified Ordinance s) of the <br />North Olmsted General Offenses shall read as follows <br />537.20 LARCENY BY TRICK. <br />No person shall obtain possession of, or title to, anything of <br />~, value with the consent of the person from whom he obtained it <br />provided he induced such consent by a false or frudulent repre- <br />sentation, pretense, token or writing. <br />Whoever violates this section shall be guilty of larceny by trick <br />and a misdemeanor if the value of the service or thing so obtained <br />or sought to be obtained is less then sixty dollars ($60.00) . <br />(ORC 2907.21 ) <br />Section 2. That any ordinance or parts of ordinances, or resolutions >or parts <br />of resolution, inconsistent with the provisions of this ordinance, are hereby repealed <br />with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 537.20 prior to this amend- <br />ment is in conflict with the provisions; of the State Statutes.
