<br /> <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- ~J~,~' <br />AN ORDINANCE ENACTING SECTION 537.19 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />O~vMSTED, OHIO , (CODIFIED ORDINANCES) EN- <br />TITLED "THREAT OF DAMAGE TO BUILDING OR OTHER <br />PROPERTY " TO GONFORM TO CHANGES ENACTED BY <br />THE OHIO GENERAL ASSEMBLY, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Council has determined that. it is ai the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Cdde be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted <br />by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1, That Section 537.19, Chapter 537 (Codified Ordinances ~~ of <br />the North Olmsted General Offenses shall read as follows : <br />537.19 THREAT OF DAMAGE TO BUILDING OR OTHER PROPERTY. <br />No person shall, through the use of the mail, telephone, <br />telegraph or other means of communication, willfully im- <br />part or convey any threat or false information knowing the <br />same to be false, concerning an attempt or alleged attempt <br />being made, or to be made, to damage or destroy any building <br />or other real or personal property for the purpose of interfering <br />with its use for educational, religious, charitable, residentiai, <br />business ,transportation or civic objectives, or of intimidating <br />any person pursuing such objectives. (ORC 2901.44 <br />Section 2. That any ordinance or party of ordinances, or resolutions or parts <br />of resolutions, inconsistent with the provisions of this Ordinance, are hereby re- <br />pealed with the effective date of this Ordinance. <br />Section 3. That this ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 537.19 prior tho this amend- <br />ment is in conflict with the provisions of the State Statutes.
