t/P.~ Y <br />• <br />r <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- ~~ <br />C~ . <br />BY: <br />AN ORDINANCE AMENDING SECTION 537.15 OF THE <br />GENERAL OFFENSES CODE OF THE CTTY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDINANCES) EN- <br />TITLED "LARCENY BY TRICK ; FRAUDULENT USE OF <br />CREDIT CARDS " TO CONFORM TO CHANGES EN- <br />ACTED BY THE OHIO GENERAL ASSEMBLY, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the <br />City of North Olmsted 'that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted by <br />the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That Section 5 3 7.18 , Chapter 5 3 7 (Codified Ordinance s) of <br />the North Olmsted General Offenses reading as follows <br />537.15 LARCENY BY TRICK ;FRAUDULENT USE OF CREDIT CARDS. <br />No person shall obtain possession of, or title to, anything of <br />v#~lue with the consent of the person fromwhom he obtained ft, <br />provided he induced such oonsent by a false or fraudulent <br />representation, pretense, token or writing. <br />No person shall steal, wrongfully appropriate, or use, with <br />intent to defraud, a credit card issued to another person. <br />No person shall, with intent to defraud, obtain or attempt to <br />obtain, purchase or attempt to purchase goods, property, <br />services or credit by the unauthorized use of a credit card <br />issued to another person. <br />No person shall, with intent to defraud, obtain or attempt to <br />obtain, purchase or attempt. to purchase goods, property, <br />services;. or credit by use of a false or counterfeit credit card. <br />No person shill,with intent to defraud, obtain or attempt to obtain, <br />purchase or attempt to purchase goods, property, services or <br />credit by use of a cancelled, revoked or expired credit card. <br />No person, with intent to defraud, shall impersonate another for <br />the purpose of obtaining or attempting to purchase goods, property, <br />services or credit. <br />The presentation of a stolen, wrongfully appropriated, false or <br />counterfeit credit card for the purpose of obtaining or attempting <br />to purchase goods, property , services or credit shall be prima- <br />facie evidence of fraudulent intent. <br />
