BY: AN ORDINANCE AMENDING SECTION 537.15 OF THE GENERAL OFFENSES CODE OF THE CTTY OF NORTH OLMSTED, OHIO, (CODIFIED ORDINANCES) EN- TITLED "LARCENY BY TRICK ; FRAUDULENT USE OF CREDIT CARDS " TO CONFORM TO CHANGES EN- ACTED BY THE OHIO GENERAL ASSEMBLY, AND DECLARING AN EMERGENCY. WHEREAS, Council has determined that it is in the best interest of the City of North Olmsted 'that the North Olmsted General Offenses Code be reviewed to eliminate any conflicts with the provisions of the State Statutes, as enacted by the Ohio General Assembly. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio Section 1. That Section 5 3 7.18 , Chapter 5 3 7 (Codified Ordinance s) of the North Olmsted General Offenses reading as follows 537.15 LARCENY BY TRICK ;FRAUDULENT USE OF CREDIT CARDS. No person shall obtain possession of, or title to, anything of v#~lue with the consent of the person fromwhom he obtained ft, provided he induced such oonsent by a false or fraudulent representation, pretense, token or writing. No person shall steal, wrongfully appropriate, or use, with intent to defraud, a credit card issued to another person. No person shall, with intent to defraud, obtain or attempt to obtain, purchase or attempt to purchase goods, property, services or credit by the unauthorized use of a credit card issued to another person. No person shall, with intent to defraud, obtain or attempt to obtain, purchase or attempt. to purchase goods, property, services;. or credit by use of a false or counterfeit credit card. No person shill,with intent to defraud, obtain or attempt to obtain, purchase or attempt to purchase goods, property, services or credit by use of a cancelled, revoked or expired credit card. No person, with intent to defraud, shall impersonate another for the purpose of obtaining or attempting to purchase goods, property, services or credit. The presentation of a stolen, wrongfully appropriated, false or counterfeit credit card for the purpose of obtaining or attempting to purchase goods, property , services or credit shall be prima- facie evidence of fraudulent intent.
