<br />r: <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO, 72- f,'"'~-- <br />~.. , <br />AN ORDINANCE ENACTING SECTION 533.10 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDINANCES) EN- <br />TITLED " POSSESSSION OF BARBITURATES OR AMPHET- <br />AMINES " TO CONFORM TO CHANGES ENACTED BY <br />THE OHIO GENERAL ASSEMBLY, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted <br />by the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section`1. TAat Section 533.10, Chapter 533 (Codified Ordinances) of the <br />North Olmsted General Offenses shall read as follows : <br />533.10 POSSESSION OF BARBITURATES OR AMPHETAMINES. <br />(a) No person shall possess a barbiturate or amphetamine unless <br />such person obtained such drug on the prescription of a prac-~ <br />titioner or in accordance with Ohio R.C. 3719.24 (A) (2 } or <br />from a person licensed by the laws of any state or the District <br />of Columbia to prescribe or dispense barbiturates or amphet- <br />amines. (ORC 3719.24 { D) ) <br />(b) This section does not apply to the classes of persons named in <br />Ohio R. C. 3719.25. <br />(c) Whoever violates this section shall, for a first offense, be guilty <br />of a misdemeanor. <br />Section 2. That any ordinance or parts of ordinances, or resolutions or parts <br />of resolutions, inconsistent with the provisions of this Ordinance, are hereby re- <br />pealed with the effective date of this Ordinance. <br />Section:3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public~~eace, safety, <br />health and welfare by virtue of the fact that Section 533.10 poor to this amend- <br />ment is in conflict with the provisions of the State Statutes. WHEREFORE, this <br />Ordinance shall take effect and be in force immediately upon its passage, other- <br />wise, at the earliest period allowed by law. <br /> <br />ATTEST: <br />~%~~ <br />'~ Presi of Council <br />Nora T.
