E CITY OF NORTH OLMSTED .'': ~~ ORDINANCE NO. 72- ~~~ PAGE 2 cannabis sativa L. , whether growing or not ;the seeds thereof ; the resin extracted from any part of such plant ; every compound, manufacture, salt, derivative, mixture or preparation of such plant, its seeds, or resin ;and tetrahydrocannabinol ;but. does not in- clude the mature stocks of such plant ;fiber produces from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture or preparation of such mature stocks except the resin extracted therefrom, fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination . (ORC 3719.40 ) (b) No person shall, with intent to produce hallucinations or illusions, purchase, use, possess or have under his control an hallucinogen. Possession or control of any hallucinogen specifically named in subsection (a) hereof constitutes prima-facie evidence of a vio- lation of this section ,except that this section Bees not apply to the use, possession or control of any hallucinogen by licnesed manufacturers, wholesalers, pharmacists owners of pharmacies, physicians end other persons, for research, clinical or medicinal purposes authorized by Federal law or any rules or regulations a- dopted pursuant thereto. (ORC 3719.41 ) (c) Whoever violates this section shall for a first offense, be guilty of a misdemeanor. Section 2. That any ordinance or parts of ordinances, or resolutions or parts of resolutions, inconsistent with the provisions of thisOrdinance, are hereby re- pealed with the effective date of this ordinance. Section 3. That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, safety, health and welfare by virtue of the fact that Section 533.09 prior to this amend- ment is in conflict with the provisions of the State Statutes.
