D <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- /j~ <br />BY: ~~~ ate-~-.+~,e~+~-- <br />AN ORDINANCE ENACTING SECTION 521.99 (e) AND <br />(f) OF THE GENERAL OFFENSES CODE OF THE CITY <br />OF NORTH OLMSTED, OHIO, (CODIFIED ORDINANCES ), <br />ENTITLED " PENALTY " TO CONFROM TO CHANGES EN- <br />ACTED BY THE OHIO GENERAL ASSEMBLY, AND DE- <br />CLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is i.n the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be rei~iewed <br />to eliminate any conflicts with the provisions of the State Statutes, as enacted by <br />the Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 521, 99 (e) and (f) ,Chapter 521 (Codified Ordinances ) <br />of the North Olmsted General Offenses shall read as follows : <br />5 21.99 PENALTY. <br />(e) Whoever violated subsections (b) or (c) (1) of Section 521.09 <br />or Section 521.10 shall be fined not more than five thousand dollars <br />( $5, 000.00) or imprisoned not more than one year, or both. <br />(f) Whoever violates subsection (c) (2) of Section 521.09 shall be <br />adjudged an unruly child, with such disposition of the case as <br />may be appropriated under Ohio R.C. Chapter 2151. <br />Section 2. That any ordinance or parts of ordinances, pr resolutions or parts <br />of resolutions, inconsistent with the provisions of this Ordinance, are hereby re- <br />pealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 521.99 prior to this amend- <br />ment is in conflict with the provisions of the State Statutes. WHEREFORE, this <br />Ordinance shall take effect and be in force immediately upon its passage, other.- <br />wise, at the earliest period allowed by law. <br />PASSED: -r .Z-. <br />ATTEST. <br />Nora T.
