p <br />A <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72-~,.~.~ <br />BY: 6 <br />AN ORDINANCE ENACTING SECTION 521.09 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, OHIO, (CODIFIED ORDINANCES) EN- <br />TITLED, "DEFINITIONS ;MATERIALS OR PERFORMANCES <br />HARMFUL TO MINORS " TO CONFORM TO CHANGES <br />ENACTED BY THE OHIO GENERAL ASSEMBLY, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the <br />City of North Olmsted that the North Olmsted General Offenses Code be reviewed <br />to eliminate any conflicts with provisions of the State Statutes, as enacted by the <br />Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That Section 521.09, Chapter 521 (Codified Ordinances) of the <br />North Olmsted General Offenses shall read as follows : <br />~ -~ <br />521.09 DEFINITIONS; MATERIALS OR PERFORMANCES HARMFUL TO MINORS. <br />(a) As used in this Section : <br />(1) Any material or performance is "harmful to m3rnors" if it contains <br />description or representation in any form of nudity, sexual conduct <br />or sexual excitement, if it is offensive to prevailing standards in <br />the adult community with respect to what is suitable for minors, and <br />if it lacks sufficient scientific, educational, sociological, moral or <br />artistic value for minors to outweigh its harmful qualities. <br />(2) "Minor " means an unmarried pion under the age of eighteen years . <br />(3) "Obscene ","nudity ", "sexual excitement ", "sexual conduct ", <br />"material "and "performance "have the same meaning as provided <br />in Section 521.10. (ORC 2903.13 ) <br />(b) No person, with knowledge of its content and character, shall <br />knowingly sell, lend, give or furnish to a minor , any material which <br />is obscene or harmful to minors. No person, with knowledge of its <br />content and character , shall knowingly present, show or exhibit to <br />a minor any performance which is obscene or harmful to minors. <br />If the offensive material or performance is harmful to minors but not <br />obscene, whoever violates this subsection (b) shall be guilty of <br />a misdemeanor for a first offense. (ORC 2903.14 ) <br />(c) (1) No person shall falsely represent that he is the parent, guardian or <br />spouse of <a minor , or furnish to a minor any identification or other <br />document purporting to show that the holder is eighteen years of age <br />or over or married, for the purpose of enabling such minor to obtain <br />any material or gain admission to any performance which is harmful <br />to minors. <br /> <br />
