p A CITY OF NORTH OLMSTED ORDINANCE NO. 72-~,.~.~ BY: 6 AN ORDINANCE ENACTING SECTION 521.09 OF THE GENERAL OFFENSES CODE OF THE CITY OF NORTH OLMSTED, OHIO, (CODIFIED ORDINANCES) EN- TITLED, "DEFINITIONS ;MATERIALS OR PERFORMANCES HARMFUL TO MINORS " TO CONFORM TO CHANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, AND DECLARING AN EMERGENCY. WHEREAS, Council has determined that it is in the best interest of the City of North Olmsted that the North Olmsted General Offenses Code be reviewed to eliminate any conflicts with provisions of the State Statutes, as enacted by the Ohio General Assembly. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio Section 1. That Section 521.09, Chapter 521 (Codified Ordinances) of the North Olmsted General Offenses shall read as follows : ~ -~ 521.09 DEFINITIONS; MATERIALS OR PERFORMANCES HARMFUL TO MINORS. (a) As used in this Section : (1) Any material or performance is "harmful to m3rnors" if it contains description or representation in any form of nudity, sexual conduct or sexual excitement, if it is offensive to prevailing standards in the adult community with respect to what is suitable for minors, and if it lacks sufficient scientific, educational, sociological, moral or artistic value for minors to outweigh its harmful qualities. (2) "Minor " means an unmarried pion under the age of eighteen years . (3) "Obscene ","nudity ", "sexual excitement ", "sexual conduct ", "material "and "performance "have the same meaning as provided in Section 521.10. (ORC 2903.13 ) (b) No person, with knowledge of its content and character, shall knowingly sell, lend, give or furnish to a minor , any material which is obscene or harmful to minors. No person, with knowledge of its content and character , shall knowingly present, show or exhibit to a minor any performance which is obscene or harmful to minors. If the offensive material or performance is harmful to minors but not obscene, whoever violates this subsection (b) shall be guilty of a misdemeanor for a first offense. (ORC 2903.14 ) (c) (1) No person shall falsely represent that he is the parent, guardian or spouse of <a minor , or furnish to a minor any identification or other document purporting to show that the holder is eighteen years of age or over or married, for the purpose of enabling such minor to obtain any material or gain admission to any performance which is harmful to minors.
