<br />BY: `~il~. ~~_.. <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- ~3~ <br />AN ORDINANCE AMENDING THE GENERAL OFFENSES <br />CODE OF THE CITY OF' NORTH OLMST£D, OHiO, <br />SECTION 509.02 (CODIFIED ORDINANCES EN- <br />TITLED, " DISTUR~IATG THE PEACE " TO CONFORM <br />TO CHANGES ENACTED BY THE OHIO GENERAL <br />ASSEMBLY, AND DLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the City <br />of North Olmsted that the North Olmsted General Offenses Code be reviewed to <br />eliminate any conflicts with provisions of the State Statutes, as enacted by the <br />Ohio General Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 509.02, Chapter 509 (Codified Ordinances) of the <br />North Olmsted General Offenses Code reading as follows : <br />509.02 DISTURBING THE PEACE. <br />(a) No person shall make or cause to be made by the use of any horn, <br />bell, radio, television, loud speaker, or by the operation of any <br />instrument or device, any unreasonably loud, disturbing, and <br />unnecessary noises of such a character, intensity and duration <br />as to disturb the peace and quiet of the Municipality or to be <br />determined to the life and health of any individual, and no person <br />shall willfully conduct himself in a noisy, boisterous or other <br />disorderly manner by either words or acts which disturb the good <br />order and quiet of the Municipality. (ORC 2923.41 ) <br /> <br />(b) No person shall disturb the good order and quiet of the Municipality <br />by clamors or noises in the night season, by intoxication, drunken- <br />ness, wrangling, committing assault, assault and battery, using <br />obscene or profane language in the streets and other public places <br />to the annoyance of the citizens, or otherwise violating the public <br />peace by indecent and disorderly conduct, or by lewd and lascivious <br />Mwhavior, or by threatening or inflicting violence or abuse to the <br />person or property of others. (ORC 715.55 ) <br />be and the same is hereby amencbd to read as follows : <br />549.02 DISTURBING THE PEACE. <br />(a) No person, by any means and after a request to desist, shall make, <br />continue to make or cause to be made any unreasonable or unneces- <br />sary noise of such a character ,intensity and duration as to disturb <br />the peace and quiet of the community or to be detrimental to the life <br />of health of any individual. <br />No person ~ by words or acts, shall willfully conduct himself in a <br />noisy, boisterous or other disorderly manner which disturbs the gaud <br />order and quiet of the community. (ORC. 2923.41 ) <br />
