CITY OF NORTH OLMSTED ORDINANCE NO. 72- ~3~ AN ORDINANCE AMENDING THE GENERAL OFFENSES CODE OF THE CITY OF' NORTH OLMST£D, OHiO, SECTION 509.02 (CODIFIED ORDINANCES EN- TITLED, " DISTUR~IATG THE PEACE " TO CONFORM TO CHANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, AND DLARING AN EMERGENCY. WHEREAS, Council has determined that it is in the best interest of the City of North Olmsted that the North Olmsted General Offenses Code be reviewed to eliminate any conflicts with provisions of the State Statutes, as enacted by the Ohio General Assembly. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio : Section 1. That Section 509.02, Chapter 509 (Codified Ordinances) of the North Olmsted General Offenses Code reading as follows : 509.02 DISTURBING THE PEACE. (a) No person shall make or cause to be made by the use of any horn, bell, radio, television, loud speaker, or by the operation of any instrument or device, any unreasonably loud, disturbing, and unnecessary noises of such a character, intensity and duration as to disturb the peace and quiet of the Municipality or to be determined to the life and health of any individual, and no person shall willfully conduct himself in a noisy, boisterous or other disorderly manner by either words or acts which disturb the good order and quiet of the Municipality. (ORC 2923.41 ) (b) No person shall disturb the good order and quiet of the Municipality by clamors or noises in the night season, by intoxication, drunken- ness, wrangling, committing assault, assault and battery, using obscene or profane language in the streets and other public places to the annoyance of the citizens, or otherwise violating the public peace by indecent and disorderly conduct, or by lewd and lascivious Mwhavior, or by threatening or inflicting violence or abuse to the person or property of others. (ORC 715.55 ) be and the same is hereby amencbd to read as follows : 549.02 DISTURBING THE PEACE. (a) No person, by any means and after a request to desist, shall make, continue to make or cause to be made any unreasonable or unneces- sary noise of such a character ,intensity and duration as to disturb the peace and quiet of the community or to be detrimental to the life of health of any individual. No person ~ by words or acts, shall willfully conduct himself in a noisy, boisterous or other disorderly manner which disturbs the gaud order and quiet of the community. (ORC. 2923.41 )
