AN ORDINANCE ENACTING THE TRAFFIC CODE OF THE CITY OF NORTH OLMSTED, OHIO, SECTIONS 377.01 to 377.99, INCLUSIVE, CHAPTER 377 (CODI- FIED ORDINANCES ), ENTITLED, "SNOWMOBILES AND ALL PURPOSE VEHICLES " TO CONFORM TO CHANGES ENACTED BY THE OHIO GENERAL ASSEMBLY, AND DECLARING AN EMERGENCY. WHEREAS, Council has determined that it is in the best interest of the City of North Olmsted that the North Olmsted Traffic Code be reviewed to eliminate any conflicts with provisions of the State Statutes, as enacted by the Ohio General Assembly . NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North Olmsted, State of Ohio : Section 1. That Sections 377.01 to 377.99, inclusive, Chapter 377 (Codi- fied Ordinances) of the North Olmsted Traffic Code shall read as follows Chapter 377 SNOWMOBILES AND ALL PURPOSE VEHICLES. 3 77.01 DEFINITIONS . (a) "Snowmobiles "means any self-propelled vehicle ;designed primarily for use on snow or ice, and steered by skis, runners or caterpillare treads . (ORC 4519.01 (A) ) (b) "All purpose vehicle "means any self-propelled vehicle de- signed prlmarily for cross-country travel on land and water, or on more than one type of terrain, and stewed by wheels or cater- pillar treads, or any combination thereof, including vehicles that operate on a cushion of air, vehicles commonly known as all- terrain vehicles, all season vehicles, mini-bike and trail bikes, but excluding any self-propelled vehicle not prlnciap~lly use for purposes of personal transportation, any vehicle principally used in playing golf, any motor vehicle or aircraft requfredto be regis- tered under Ohio R.C. Chapter 4503 or Chapter 4561, and any vehicle excepted from definition as a motor vehicle by Section 301.17 of this Traffic Code (ORC 4519.01 (B) ) (c) "Owner "means any person, firm or corporation, other than a lienholder or dealer, having title to a snowmobile or all purpose vehicle, or other right to the possession thereof (ORC 4519.01 (C ) (d) "Operator " means any person who operates or ie in actual physical contrel of a snowmobile or all purpose vehicle. (ORC 4519.01 (D) ) (e) "Limited access highway " or "freeway " means a highway es- pecially designed for through traffic end overwbhich abuttting property owners have no easement or right of access by reason of the fact that their property abuts upon such highway, and access to which may be allowed only at highway intersections designated by the Ohio Director of I~ghn~ays.
