<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72-~~.~ <br />~~ . <br />BY: <br /> <br />AN ORDINANCE AMENDING THE TRAFFIC CODE OF <br />THE CITY OF NORTH OLMSTED, OHIO, SECTION <br />371.02 (CODIFIED ORDINANCES ), ENTITLED, <br />" RIGHT OF WAY OF SLIND PERSON " TO CONFORM <br />TO CHANGES ENACTED BY THE OHIO GENERAL <br />ASSEMBLY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the City <br />of North Olmsted that the North Olmsted Traffic Code be reviewed to eliminate any <br />conflicts with provisions of the State Statutes, as enacted by the Ohio General <br />Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 371.02, Chapter 371 (Codified Ordinances ~ of the <br />North Olmsted Traffic Code reading as follows ; <br />371.01 RIGHT OF WAY OF BLIND PERSON <br />The driver of every vehicle shall yield the right of way to <br />every blind pedestrian guided by a guide dog, or carrying <br />in a raised or extended position a white cane or white cane <br />with a red tip. <br />As used in the section "blind person " or b11nd pedestrian " <br />shall mean a person having not more than 20/200 visual acuity <br />in the better eye with correcting lenses or visual acuity greater <br />than 20/200 but with a limitation in the fields of vision such <br />that the widest diameter of the visual field subtends an angle <br />no greater than twenty degrees . <br />No persoh, other than a blind person, while on any public <br />street, highway, alley, or other phblic thoroughfare shall <br />carry in a raised or extended position a white cane or a <br />white cane with a red tip. (ORC 4511.47 ) <br />be and the same is hereby amended to read as follows: <br />371.02 RIGHT OF WAY OF BLIND PERSON <br />(a) As used in this section "blind person " or "blind pedestrian " <br />means a person having not more than 20/200 visual acuity in <br />the better eye with correcting lenses or visual acuity greater <br />than 20/200 but with a limitation in the fields of vision such <br />that the widest diameter of the visual field subtends an angle <br />no greater than twenty degrees. <br />The driver of every vehirdle shall yield the right of way to every <br />blind pedestrian guided by a guide dog, or carrying a cane which <br />is predominantly white or metallic in color, with or without a red <br />tip. <br />(b) No person, other than a blind person, while on any public high- <br />way, street, alley or other public thoroughfare shall carry a white <br />or metallic cane, with or without a red tip.
