C <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- ~~~ <br />BY:~~NJ <br /> <br />AN ORDINANCE AMENDING THE TRAFFIC CODE OF <br />THE CITY OF NORTH OLMSTED, OHIO, SECTION <br />303.99 (e) (CODIFIED ORDINANCES ), ENTITLED, <br />" PENALTIES " TO I}ONFORM TO CHANGES ENACTED <br />BY THE OHIO GENERAL ASSEMBLY, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, Council has determined that it is in the best interest of the City <br />of North Olmsted that the North Olmsted Traffic Code be reviewed to eliminate any <br />conflicts with provisions of the State Statutes, as enacted by the Ohio General <br />Assembly. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 303.99 (e) , Chapter 303 (Codified Ordinances ) <br />of the North Olmsted Traffic Code reading as follows : <br />303.99 PENALTIES <br />(e) Whoever violates Sections 343.01 (e ), 343.02 or 343.03 shall <br />be fined not more than five hundred dollars ($500.00) or im- <br />prisoned not more than six months, or both, for a first offense. <br />be and the same is hereby amended to read as follows <br />303.99 PENALTY <br />(e) Whoever violates Section 343.01, 343.02, B#~3.03 or 343.05 <br />shall be fined not more than five hundred dollars ($500.00 ) <br />or imprisoned not more than sig months, or both. <br />Section 2. That any ordinance or parts of ordinances, or resolutions or <br />parts of resolutions, inconsistent with the provisions of this Ordinance, are <br />hereby repealed with the effective date of this Ordinance. <br />Section 3. That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, safety, <br />health and welfare by virtue of the fact that Section 303.99 (e) prior to this <br />amendment is in conflict with the provisions of the State Statutes. WHEREFORE, <br />this Ordinance shall take effect and be in force immediately upon its passage, <br />otheYwise, at the earliest period allowed by law. <br />PASSED: .,~~.a~-- <br />ATTEST: <br />. ©, <br />Nora T.
