' Fw ,, ~~. <br />'` j` y <br />_~, <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 72- ~~e~ <br />BY:_ i~~- . <br />AN ORDINANCE AMENDING PART 5, CHAPTER 505, <br />SECTION 505.07, ENTITLED " BARKING AND <br />HOWLING DOGS " (CODIFIED ORDINANCES) AND <br />DECLARING AN EMERGENCY. <br />BE IT ORDAINED by the Council of the City of North Olmsted, State of <br />Ohio : <br />Section 1. That Part 5 entitled "General Offense Code ", Chapter 505 <br />entitled "Animals ", Section 505.07 entitled "Barking and howling dogs "now <br />reading as follows : <br />505.07 BARKING AND HOWLING DOGS. <br />No person shall keep or harbor within the City, any dog which <br />by barking, biting, howling or in any way or manner injures or <br />disturbs the quiet of any other person. <br />be and the same is hereby amended to read as follows : <br />505.07 ANIMAL NtTISANCE CONDITIONS PROHIBITED. <br />(a) No person shall keep or harbor any animal in the City so as <br />to permit the commission or evidence of a nuisance as here- <br />inafter defined. <br />(b) Any animal which disturbs the peace and quiet or endangers the <br />repose, or health of persons by frequent or habitual barking, <br />howling, or yelping, or which scratches or digs in or urinates <br />or defecates upon any lawn, tree, shrub, plant, building or any <br />other property, private or public, other than the property of the <br />owner or person in charge or control of such animal is hereby <br />declared to be a nuisance. <br />(c) On complaint of any person or police officer that an animal <br />harbored or kept in the City and disturbs the peace and quiet <br />or damages property in the manner as specified above, notice <br />therefore shall be given to the person harboring or keeping <br />such animal. Failure to abate the nuisance complained of <br />shall subject the person to penalty for violation of this Section. <br />(d) In the case of defecation wherein the owner or person in charge <br />or control of such animal, shall remove all feces deposited by <br />such animal and disposes of same in a sanitary manner, such <br />nuisance shall be considered abated. <br />Section 2. That any ordinance or resolution, or parts of ordinances or <br />resolutions, inconsistent with the provisions of this Ordinance, are hereby <br />repealed with the effective date of this Ordinance. <br />
