.-. , , ~i' CITY OF NORTH OLMSTED RESOLUTION NO. 72- ~/ A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO RELEASE SUBSTITUTED EASEMENTS IN EXCHANGE FOR THE GRANTING TO THE CITY OF NEW EASE- MENTS FOR THE EXTENSION OF BROOKPARK ROAD. WHEREAS, the Council of the City of North Olmsted has adop- ted a resolution approving the extension and relocation of Brookpark Road in accordance with plans submitted by Spartico DiBenedetto on May 3, 1972; and WHEREAS, the City has in granted by Spartico DiBenedetto, of Cuyahoga County Records, and' corded in Volume 12761, Page 293 the Capital National Bank, which and its possession certain easements recorded in Volume 12555, Page 211 ~y Adelbert B. Kleine, Trustee, re- of Cuyahoga County Records, and by bears Recorder's Receipt No. 389689; WHEREAS, the said easements were for the purpose of the con- struction of the Brookpark Road extension; and WHEREAS, the easements describe land in a different location than the proposed location of Brookpark Road extension in accordance with the plan of May 3, 1972. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of North Olmsted, State of Ohio: Section 1. That the Mayor is hereby authorized to release the above referred to easements to the grantors thereof in exchange for other easements which would describe Brookpark Road extension in accordance with the plan dated May 3, 1972.. Section 2. WHEREFORE, this Resolution shall take effect and be in force at the earliest date permitted by Artiele IV, Section 12 of the Charter of the City of North Olmsted.
