C <br />CITY CF' NORTH OLMSTED <br />RESOLUTION NO. 72-~Q <br />BY: j~: ~~~.~. <br />A RESOLUTION OBJECTING TO THE GRANTING <br />OF A D-5 LIQUOR PERMIT BY THE STATE OF <br />OHIO TO THOMAS FRANCIS STACK DBE TOMS, <br />AND DECLARING AN EMERGENCY. <br /> <br />WHEREAS, the area known as 25054 Lorain Road, North Olmsted, Ohio, <br />is presently zoned "Mixed Use " as established by the Zoning Code of the City <br />of North Olmsted ;and <br />WHEREAS, "Mixed Use "zoning does not permit the establishment of a <br />restaurant or lounge for the purposes of selling food or alcoholic beverages ;and <br />WHEREAS, Council now wishes to object to the granting of a liquor permit <br />in an area not established for the operation of the lounge or restaurant. <br />NOW, THEREFORE, BE IT RESOLITED by the Council of the City of North <br />Olmsted, State of Ohio <br />Section 1. That the State of Ohio , Department of Liquor Control, is <br />respectfully requested to refuse the New D-5 No. 8477619 liquor permit applied <br />for by Thomas Francis Stack dbs Toms on the jaasis that the address given by the <br />applicant is now zoned "Mixed Use ". The "Mixed Use "zoning area does not <br />permit the operation of a restaurant or lounge bar, and ,therefore, the area, <br />25054 Lorain Road, North Olmsted, Ohio, is not suitable for the operation of a <br />lounge bar or restaurant serving alcoholic beverages. <br />Section 2. This Resolution is hereby declared to be an emergency measure <br />necessary for the preservation of the public peace, wel~re and safety and health <br />of the City, by virtue of the fact that a hearing will be had regarding the above <br />permit on March 9, 1972, and,v~herefore, this resolution shall take effect and <br />be in force immediately upon its passage and signature by the Mayor. <br />PAS SE D• /~~~-~_..fi 7, /~7.Z.,- <br />ATTEST; <br />~~ .~~~~ <br />Nora T.
