<br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. ~~='L~ <br />BY ~ .c:e:.~~...~, <br />_-~~ <br />A RESOLUTION DI~CLARING THE NECESSITY OF CONSTRUCTZI~G <br />CIItTAIN SIbEWALffi ON i~3T PARE DRIVE, NORTH PARK <br />DRNE AND ROOT ROAD, RlQUTRING THAT ABiIlTI~'G PROPI~RTY <br />OWNERS C0~!tSTRUCT THE 3A~lE, AND DNCLARIIR: AN ICY. <br />BE IT RESOLVED by the Council of the City of North Olmsted, Cuyahoga <br />County, Ohio: <br />Section l: That it is necessary to construct concrete sidewe~lks in <br />accordance with the plans, specifications and esti~,tes of a®at therefor <br />prepared by the City Engineer and now on file in the office of the Clerk of <br />Council, at the following 1©cations: <br />West side of West Park Drive from Lorain Rand to North Park Drive <br />North side of North Park Drive from Martin Drive to Porter Read <br />West side of Root Road froaa Lorain Road northerly 3,085 feet <br />Section 2: What the plans, specifications and estimate of cost for <br />said construction as heretofore filed be and the same are hereby approved. <br />Section 3: That the owners of s1.1 lots and lands bounding and <br />abutting upon the proposed sidewalks shall construct, in accordance with the <br />plans and specifications now an file, the portion of such sidewalks abutting <br />on their respective properties xithin s period of thirty days after service <br />of notice of the passage of this resolution; and, if such construction shall <br />not be ecm~leted within such period of thirty days, then this Council shall <br />have the same done and the entire cost thereof shall be assessed upon the <br />property of each defaulting owner and made a lien thexean, to be coLteated in <br />the manner provided by law, with petsalty and interest as provided by laa. <br />Section 1~: That the Clerk of this Council is directed to cause a <br />written notice of the passage of this resolution to be served on each affected <br />property owner as required by law. <br />Section 5: That this resolution is hereby declared to be an <br />earergency measure necessary for the imediate preservation of the public peace, <br />health and safety by virtue of the need for the mate construction of such <br />sidewalks to permit safe passage by persons using said streets and to eli~ed.nate <br />existing hazards to pedestrians; wherefore, this resolution shall. be in fa3.l. <br />force and effect from at~d. ima~ediately after its passage and. approval by the Mayor. <br />PASSED , 1971 <br />~a., .~ ~ D <br />ATTEST: <br />~~ ~~z.~~ <br /> <br />
