Geiger, heretnafter referred to as the Owners WHEREAS, the City is tnvofved in a scarper recreational swim program and hes requested the use of the Owners swimming pool far such program, and WHEREAS, the Owners desire to allow the use of such pool by the recreattc+n departr!~snt of the Ctfi,~ NOW, THEREFt)RE, tt is agreed by and between the parties as toltowst t. The Owners hereby grant to the City of North Olmsted and its recreation department the right to use the Owner's swimming pool located at property known as 2Etd29 Lora i n rooad, worth U I mated far the C i ty ~ s sumrper rscreatton swim program subJect to the foliawing conditions. ta) The City will make whatever repairs, instatia#tons or other corrocttve measures as era necessary to make the pawl safe and suitable for the Cttyts program, tb) The pool shall be used at such time as is agreed between the; i City and the Owners. a' j I tc) The City will keep the pool in good condition and repair and will matntatn the cleanliness and sanitation thereo# during the entire Course of its program. The City will return the pool to' the owners in the same condition as received,"gradual wear and teak excepted".
