That it is hereby determined to proceed with the <br />improvement of the Following streets within the City of North Olsmsted <br />by replacing and rega~iring sideealks: <br />a« Burns Road -Butternut Ridge Road to Southern Avenue. <br />b. Georgette - etttire length. <br />c. Maple Ridge -Walter Road to Claque Road. <br />d. Claque Road --Elm Road to Stoneybrook. <br />e. Carey Lane -Allendale to Columbia Road. <br />f. South Porter Road -Southern Avenue to Lorain Road. <br />g. Sherrrood Drive - Iynhaven to Windsor. <br />h. Maria Lane -Walter Road to end. <br />i. Coe Avenue -Elm Road to Lorain Road. <br />Section 2. That said improveament shall be made in accord~ee <br />with the provisions of Resolution No. 70-139 passed on August 19, 1970, <br />a~i with the plans, specifications, estimates and profiles heretofore <br />approved and noK on File in the of'f'ice of the Clerk of this Cceil. <br />Section 3~ That all claims for damages xesulting therefrom <br />that have been legally filed shall be inquired into aFter cos~etion <br />of the proposed 3.spnt, and the Director of Lax is hereby auth- <br />orized and directed to institute legal proceedings in a court of cos~- <br />petent jurisdiction to inquire into claims that have been so filed. <br />Section ~+. That, subject to the provisions of Section 5 <br />hereof, the portion of the cost provided in the above-mentioned resolu- <br />tion of necessity to be assessed shall be assessed in the n~ner and <br />the number of installments provided in said resolution and on the lots <br />and lands described therein. <br />Section 5. That the estimated assessments for-:much #~rove- <br />ment heretofore prepared by the City Engineer, and filed in the office <br />of the Clerk of Council and as equalized by the Assesameaat Equalisation <br />Board heretofore appointed for such purpose by Resolution No. 70-161., <br />adopted October 6, 1970, the report of which Board was e-roved by Res- <br />olution No. ,Z~G ,adopted May 18, 1971, be and the same are here- <br />by adopted, are in proportion to the benefits which may result from such <br />improvements and are not in excess of any statutory limitation. The <br />reductions in the estimated assessments recoa~ended by the Assessment <br />Equalization Board shall be assumed by the City in addition to that por- <br />tion of the cost of such improvement which the City is required to pay <br />wader the provisions of the above-mentioned resolution of necessity. <br />
