<br />Ordinance No.~ 9 Page 2 <br />invt~ilate for public highway purposes. and permit no signs, posters, <br />billboards, roadside stands or other private installations within <br />the right-of-way limits; and <br />(c) Prohibit parking within the limits of the installation project <br />under this ordinance, within the corporate limits of the Muni- <br />cipality; and <br />(d) No rule or regulation shall be enacted restricting the use of the <br />highway by any class of vehicle or vehicle load permitted by the <br />Ohio Revised Code to use a public highway. Any existing rule or <br />regulation so restricting road usage is hereby rescinded. <br />Section 5. (Traffic Control Signals and Devices) <br />That traffic control signals will not be installed on the project with- <br />out prior approval by the County and the Municipality will place and maintain <br />all traffic control devices conforming to the Ohio Manual of Uniform Traffic <br />Control Devices on the installation project in compliance with the provisions <br />of Section 4511.11 and related sections of the Ohio Revised Code. <br />Section 6. (Utility Rearrangement) <br />(a) That arrangements shall be made with and agreements obtained from <br />all public utility companies whose facilities will be affedted by <br />the said installation project and said companies shall agree to <br />make any and all necessary rearrangements of facilities in such a <br />manner as to be clear of any construction called for by the plans <br />of said improvement and said companies shall agree to make such <br />necessary rearrangements immediately after notification by said <br />Municipality or the County of Cuyahggg. <br />(b) That it is hereby agreed that the Munic ipality shall at its own <br />expense make all rearrangements of both municipally owned and <br />privately owned utilities and/or any appurtenances ttcereto, as <br />may be necessary to conform to the said installation project and <br />said rearrangements shall be done at such time as requested by <br />the County. <br />(c) That the construction, reconstruction and/or rearrangement of <br />both publicly and privately owned utilities, referred to in sub- <br />sections (a) and (b) above, shall be done in such a manner as to <br />not interfere unduly with the operation of the contractor install- <br />ing the project and all backfilling of trenches made necessary by <br />such utility rearrangements shall be performed in accordance with <br />the provisions of the Ohio Department of Highways Construction and <br />Material Specifications and shall be subject to approval by the <br />county. <br />Section 7. (Emergency Clause) <br />This Ordinance is hereby declared to be an emergency ordinance imme- <br />diately necessary for the preservation of the public peace, health and safety, <br />such emergency existing by reason of the present condition of said road and by <br />reason of the inadequacy of such road to handle existing and anticipated <br />vehicular traffic between the points hereinbefore designated; in consequence <br />whereof great public inconvenience is being suffered and will be suffered and <br />public vehicular traffic endangered and delayed; and for the further reason <br />it is necessary to proceed at once in order to complete the installation <br /> <br />
