<br />~,; <br />CITY OF NORTH OLMSTED <br />== <br />ORDINANCE NO. 71- ~~ <br />AN ORDINANCE TO PROVIDE FOR WRITTEN <br />NOTICE OF WITHDRAWAL FROM THE AGREE- <br />MENT FOR CENTRAL COLLECTION OF MUNICI- <br />PAL INCOME TAXES BETWEEN NOSH OLMSTED <br />AND, THE CITY OF CLEVELAND AND OTHERS, <br />AND I?ECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted previously entered into an agree- <br />ment with the City of Cleveland and other municipalities whereby the City of <br />Cleveland Division of Taxation functions as a Central Collection Agency for <br />municipal income taxes levied by the participants to the agreement ;and <br />WHEREAS, Article IX, Paragraph A of such agreement provides, in <br />part, <br />" any participant may withdraw from this agreement for the <br />operation of a Central Collection Agency provided, however, <br />that any such withdrawal shall be effective only on December <br />31 of any given year and shall be preceded by written notice <br />of withdrawal via registered mail and return receipt, received <br />by the Agency Administrator no later than Bebruary 20 prior to <br />the effective date of such withdrawal. " ;and <br />WHEREAS, due to the announced intention of the City of Cleveland <br />to cancel tax repiprocity, this community must amend its income tax ordinance <br />in a manner inconsistent with the agreement for Central Collection . <br />NOW, THEREFORE, BE TT ORDAINED by the Council of the City of <br />North Olmsted, State of Ohio : <br />Section 1. That the City of North Olmsted withdraws from such agree- <br />ment effective December 31, 1971. <br />Section 2. That the Clerk of Council is hereby authorized and directed <br />to give notice of such withdrawal in writting along with a certifiestdcopy ©f this <br />Ordinance to Mr. Louis V. Corsi, Administrator of the Central Collection Agency, <br />1701 Lakeside Avenue, N.E. , Cleveland, Ohio, 44114, by registered mail, return <br />receipt requested, prior to February 15 , 19 7I. <br />Section 3. That this Ordinance is hereb~r declared to be an emergency <br />measure necessary for the public peace, safety, health and welfare of the City <br />by virtue of the fact that failure to revise the municipal income tax ordinance as <br />stated in the preamble will result in a shortage of funds necessary to continue <br />the normal operation of this municipality. WHEREF~tE, this Ordinance shall <br />take effect and be in force immediately upon its passage, otherwise, at the <br />earliest period allowed by law. <br />PASSED: `C!,l~.c _,;~ <br />ATTEST: <br />~~~ <br />Nora T.
